【摘要】:氣候變化是人類當(dāng)前面臨的關(guān)乎生死存亡的重大危機。自太平洋島國帕勞總統(tǒng)托里比翁(Johnson Toribiong)于2011年9月的聯(lián)合國峰會上呼吁聯(lián)大向國際法院尋求咨詢意見"以確定各國是否有法律責(zé)任確保其領(lǐng)土上的任何排放溫室氣體的行為不會危害其他國家"以來,"氣候變化不利影響的損失損害國際機制"成為歷次世界氣候大會上發(fā)達國家與發(fā)展中國家的博弈焦點,終于2013年華沙氣候大會上形成氣候變化不利影響的華沙損失損害國際機制,成為了當(dāng)前應(yīng)對氣候變化國際環(huán)境立法領(lǐng)域的一個焦點和難點問題。本文從氣候變化不利影響的客觀現(xiàn)實入手,深刻揭示了氣候變化不利影響所導(dǎo)致的損失與危害的華沙機制的法律屬性,將其界定為"氣候變化所致?lián)p失損害補償責(zé)任",從國際環(huán)境立法的角度進一步豐富和發(fā)展了國家責(zé)任理論。
[Abstract]:Climate change is a major life-or-death crisis facing humanity. At the September 2011 United Nations summit, President of Palau President of the Pacific island Palau, Johnson Toribiong, called on the General Assembly to seek an advisory opinion from the International Court of Justice. Since determining whether States have a legal responsibility to ensure that any act of greenhouse gas emission on their territory does not endanger other countries, the International Mechanism for loss and damage from the adverse effects of Climate change has been issued at the World Climate conferences. The focus of the game between Darfur and developing countries, Finally, at the Warsaw Climate Conference on 2013, the Warsaw International Mechanism for loss and damage, which was adversely affected by climate change, was formed. It has become a focus and difficult problem in the field of international environmental legislation to deal with climate change. This paper starts with the objective reality of adverse effects of climate change. Profoundly revealing the legal attributes of the Warsaw mechanism for the loss and harm caused by the adverse effects of climate change, It is defined as "compensation liability for damage caused by climate change", which further enriches and develops the theory of state responsibility from the angle of international environmental legislation.
