【摘要】：現(xiàn)代人工生育技術(shù)對以自然生育為基礎(chǔ)的傳統(tǒng)親子法造成了沖擊,現(xiàn)有規(guī)定已不能完全適用于人工生育行為中的親子關(guān)系。對于母親身份的確定,在非代孕型人工生育中,無論是否使用了捐卵,都應(yīng)當(dāng)確定分娩者為母,捐卵者不能成為子女的法律母親；而在代孕型人工生育中,由于代孕委托雙方分別行使了生育權(quán)和身體權(quán),應(yīng)當(dāng)確定委托方女性為母,代孕者對子女不享有親權(quán)。對于法律父親的確定,在非捐精型人工生育中,應(yīng)依據(jù)男性與子女間的血緣聯(lián)系確定法律父親。在捐精型人工生育中,如生育主體是夫妻,應(yīng)依據(jù)傳統(tǒng)的婚生子女推定原則確定丈夫為父親,丈夫事前同意的,嗣后不能以無血緣關(guān)系為由否認(rèn)；如生育主體是無婚姻關(guān)系的情侶,男方需事先同意才能被確認(rèn)為父親。人工生育子女應(yīng)被確定為法律父母的自然血親子女,享有與自然生育子女同樣的法律身份,其是否具有婚生子女地位,依受孕時父母間是否有婚姻關(guān)系而定。人工生育子女應(yīng)依法享有出身知情權(quán)。對于人工生育技術(shù)下的親子關(guān)系立法,我國應(yīng)拓寬有關(guān)規(guī)定的主體范圍、補(bǔ)充特殊人工生育中的親子關(guān)系認(rèn)定規(guī)則、確立人工生育子女的法律地位,并提高人工生育技術(shù)下親子法的立法位階。
[Abstract]:Modern artificial fertility technology has impacted on the traditional parent-child method based on natural fertility, and the existing regulations can no longer fully apply to the parent-child relationship in the artificial fertility behavior. For the determination of the mother's identity, in the non-surrogate type of artificial fertility, Whether or not an egg donation has been used, the mother of the child should be determined, and the donor cannot become the legal mother of the child; and in the case of surrogate artificial birth, the right to bear and the right to body are exercised by the surrogate, respectively, because of the entrustment of the surrogate. The surrogate shall not enjoy parental authority over the child. For the determination of the legal father, the legal father shall be determined on the basis of the blood relationship between the male and the child in the determination of the legal father, and the legal father shall be determined on the basis of the blood relationship between the male and the child. If the reproductive subject is a husband and wife, the husband should be determined as the father according to the traditional principle of presumption of legitimate children, and if the husband consents in advance, he may not later deny it on the grounds of lack of consanguinity; if the reproductive subject is a couple without marriage, In order to be recognized as a father, the man must have prior consent. A child born artificially shall be determined to be a natural blood relative of a legal parent, shall have the same legal status as a child born naturally, and whether he has the status of a legitimate child, It depends on whether or not there is a marriage relationship between parents at the time of conception. Children born artificially should enjoy the right to know their origin according to law. For the legislation on parent-child relations under artificial fertility technology, China should broaden the scope of the subject of the relevant provisions. To supplement the rules of parent-child relationship identification in special artificial fertility, to establish the legal status of artificial children, and to improve the legislative rank of parent-child law under artificial fertility technology.
