【摘要】：近年來,自然災(zāi)害頻發(fā)。民眾在喪失家園的同時,還要承受各種不便和痛苦。如何切實保護(hù)受自然災(zāi)難影響的民眾的人權(quán),是我們亟待解決的問題。 本文首先從自然災(zāi)難中人權(quán)保護(hù)的重要性出發(fā),對面臨自然災(zāi)害時人權(quán)保護(hù)的現(xiàn)狀和人權(quán)的倡導(dǎo)進(jìn)行論述,希望全社會樹立關(guān)注受自然災(zāi)害影響的人的人權(quán)保護(hù)意識。并對自然災(zāi)難發(fā)生的前后,人權(quán)工作者和政府應(yīng)該如何從細(xì)微處切實保護(hù)民眾的人權(quán)展開闡述,并結(jié)合國際人權(quán)條約中的保護(hù)機(jī)制,對人道主義救援行動進(jìn)行約束和規(guī)范,保護(hù)受災(zāi)難影響的民眾的生存權(quán)及其他與生命相關(guān)的權(quán)利,嚴(yán)格限制對與生命所需基本權(quán)利的克減。同時本文結(jié)合聯(lián)合國機(jī)構(gòu)間常設(shè)委員的文件對自然災(zāi)難發(fā)生中人權(quán)保護(hù)的具體操作步驟和行動指南進(jìn)行細(xì)化,對生存權(quán)等與生命基本所需相關(guān)的權(quán)利進(jìn)行針對性保護(hù)。對社會弱勢群體的人權(quán)保護(hù)的程度是檢驗一國人權(quán)狀況的標(biāo)尺。本文針對不同群體的特殊需求,對自然災(zāi)難中婦女、兒童、老人、殘疾人的權(quán)利狀況進(jìn)行詳細(xì)說明,希望能從這些容易被忽略的部分著手,使這些弱勢群體的人權(quán)能夠得到切實保護(hù)。國際社會對受自然災(zāi)難的民眾人權(quán)進(jìn)行保護(hù)時,難免會與某受災(zāi)國主權(quán)沖突,本文最后對如何平衡自然災(zāi)難中人權(quán)保護(hù)和主權(quán)獨立的關(guān)系進(jìn)一步闡述,希望能達(dá)到二者的和諧統(tǒng)一。
[Abstract]:In recent years, natural disasters occur frequently. People lose their homes, but also suffer all kinds of inconvenience and pain. How to protect the human rights of people affected by natural disasters is an urgent problem to be solved. This paper begins with the importance of human rights protection in natural disasters, and discusses the current situation and advocacy of human rights protection in the face of natural disasters. Hoping that society as a whole will develop an awareness of the protection of human rights of those affected by natural disasters and elaborate on how human rights workers and governments should effectively protect the human rights of the population in detail before and after natural disasters occur, And, in the context of the protection mechanisms in international human rights treaties, to regulate and regulate humanitarian relief operations and to protect the right to life and other life-related rights of disaster-affected populations, Strictly limiting derogations from fundamental rights to life. In conjunction with the documents of the United Nations Inter-Agency standing Committee, the present paper elaborates on specific operational steps and operational guidelines for the protection of human rights in the event of natural disasters, The degree of human rights protection for vulnerable groups in society is a yardstick to test the human rights situation in a country. This paper aims at the special needs of different groups and applies to women in natural disasters. The rights of children, the elderly and the disabled are described in detail, hoping to start with these easily neglected parts. Enabling the human rights of these vulnerable groups to be effectively protected... when the international community protects the human rights of populations affected by natural disasters, it is inevitable that there will be a conflict of sovereignty with an affected State, At the end of this paper, how to balance the relationship between human rights protection and sovereignty independence in natural disasters is further elaborated, hoping to achieve the harmony and unity of the two.
