【摘要】：自從人類進(jìn)入太空時(shí)代以來,空間科學(xué)家就一直試圖對(duì)人類空間活動(dòng)可能帶來的空間環(huán)境風(fēng)險(xiǎn)進(jìn)行科學(xué)地分析和研究。上世紀(jì)60年代至今,射入外層空間的衛(wèi)星和火箭數(shù)目驚人。科學(xué)家們特別關(guān)心的是以科學(xué)研究為目的射入外層空間的物體將會(huì)在外層空間引起放射性污染、生態(tài)污染以及化學(xué)性污染。外層空間環(huán)境保護(hù)問題也隨之成為國際社會(huì)熱點(diǎn)問題。在許過國家因?yàn)橥馓栈顒?dòng)受益的同時(shí),外層空間由于遭受各種即在的或潛在的污染而逐漸引起國際社會(huì)和各個(gè)國家的關(guān)注。外空環(huán)境的保護(hù)是全人類的共同責(zé)任,我國作為主要的航空大國,更應(yīng)當(dāng)發(fā)揮積極的作用,推動(dòng)空間事業(yè)可持續(xù)健康的發(fā)展。 本文旨在通過對(duì)外層空間的界定進(jìn)而提出近年來逐步發(fā)展中的外層空間活動(dòng),諸如外層空間商業(yè)活動(dòng),外層空間科學(xué)研究活動(dòng),以及外層空間軍事活動(dòng)對(duì)外層空間環(huán)境所產(chǎn)生的各種污染,分析了空間環(huán)境問題的嚴(yán)重性�？臻g碎片是目前外層空間污染的主要方面,外太空核污染和化學(xué)污染問題因其潛在的危害性也不能掉以輕心,外空生物污染雖然目前還并沒有產(chǎn)生嚴(yán)重危害,但是以空間碎片為主要污染形式的外空環(huán)境保護(hù)問題引起學(xué)界的廣泛關(guān)注。 針對(duì)這些環(huán)境問題,本文歸納了外層空間環(huán)境保護(hù)的法律框架及其存在的問題,并提出了完善外層空間環(huán)境保護(hù)制度的設(shè)想。本文的最后一部分闡述了我國作為一個(gè)航天大國,現(xiàn)階段沒有出臺(tái)一部規(guī)范空間活動(dòng)的法律、法規(guī)和政策,這對(duì)于日益發(fā)展的空間產(chǎn)業(yè)來說顯得相對(duì)滯后。為了推進(jìn)我國航天事業(yè)的進(jìn)一步發(fā)展,我國應(yīng)加快空間立法。借鑒其他國家的優(yōu)秀體系和做法,加快我國空間立法的步伐,樹立有責(zé)任的航天大國的形象。
[Abstract]:Since mankind entered the space age, space scientists have been trying to carry out scientific analysis and research on the possible space environmental risks caused by human space activities. The number of satellites and rockets launched into outer space is alarming. Scientists are particularly concerned that objects launched into outer space for scientific purposes will cause radioactive contamination in outer space, Ecological pollution and chemical pollution. The protection of the outer space environment has also become a hot issue in the international community. While allowing countries to benefit from outer space activities, The protection of outer space, which has gradually attracted the attention of the international community and individual States as a result of all kinds of immediate or potential pollution, is the common responsibility of all mankind, and our country, as a major aviation power, should play an active role, To promote the sustainable and healthy development of the space cause. The purpose of the present paper is to propose, through the definition of outer space, the progressive development of outer space activities in recent years, such as commercial activities in outer space, research activities in outer space science, As well as the various pollution of the outer space environment caused by military activities in outer space and the analysis of the seriousness of the space environment problem. Space debris is the main aspect of the current pollution of outer space, The problem of nuclear and chemical pollution in outer space cannot be taken lightly because of its potential harm. Although the biological pollution of outer space has not caused serious harm at present, However, space debris as the main form of pollution of outer space environmental protection has attracted extensive attention. In view of these environmental problems, this paper summarizes the legal framework of outer space environmental protection and its existing problems. The last part of this paper states that China, as a large spaceflight country, has not issued a law, regulation and policy to regulate space activities at this stage. In order to promote the further development of China's space industry, China should speed up space legislation, learn from the excellent systems and practices of other countries, and speed up the pace of China's space legislation. Build up the image of a responsible spaceflight power.
