【摘要】：隨著WTO多哈回合談判陷入僵局,WTO體制出現(xiàn)了貿(mào)易規(guī)則制定的諸邊化趨勢,其條約形式是諸邊協(xié)定。傳統(tǒng)上,諸邊協(xié)定僅指WTO中的"諸邊貿(mào)易協(xié)定",但以《信息技術(shù)協(xié)定》為代表的諸邊協(xié)定新類型已經(jīng)出現(xiàn)。諸邊協(xié)定概念的外延得到擴展,概念本身亦有待澄清�！缎畔⒓夹g(shù)協(xié)定》自1997年生效后得到了有效執(zhí)行,并于2015年完成了擴圍談判,積累了較為豐富的條約實踐,對于重新理解諸邊協(xié)定這一WTO條約體系中已有條約類型具有重要意義。本文在對《信息技術(shù)協(xié)定》進行實證研究的基礎(chǔ)上,將諸邊協(xié)定定義為在WTO體制中由兩個或兩個以上的部分WTO成員就某個或某類議題進行談判且僅對接受它的成員具有約束力的協(xié)定。通過諸邊協(xié)定制定貿(mào)易規(guī)則已成為WTO貿(mào)易規(guī)則制定的重要補充方式。
[Abstract]:With the deadlock in the WTO Doha Round negotiations, there has been a trend of plurilateral trade rule-making in the WTO system, which has taken the form of plurilateral agreements. Plurilateral agreements refer only to "plurilateral trade agreements" in WTO, but new types of plurilateral agreements, represented by the Information Technology Agreement, have emerged. The concept itself has yet to be clarified. The Information Technology Agreement has been effectively implemented since its entry into force on 1997, and the expansion negotiations were completed in 2015, resulting in a wealth of treaty practice, It is of great significance to re-understand the plurilateral agreement, which is an existing treaty type in the WTO treaty system. Based on the empirical study of the Information Technology Agreement, A plurilateral agreement is defined as an agreement in the WTO system in which two or more WTO members negotiate on one or a particular topic and are binding only on the member that accepts it. Trade rules have been established through plurilateral agreements. WTO trade rules become an important complementary way.
