【摘要】：網(wǎng)絡(luò)恐怖主義犯罪是恐怖主義犯罪在互聯(lián)網(wǎng)時(shí)代下的一種新的發(fā)展模式,是恐怖主義與網(wǎng)絡(luò)的結(jié)合。這種犯罪結(jié)合了互聯(lián)網(wǎng)的特點(diǎn)的同時(shí)保留了恐怖主義特點(diǎn),使其在給世界人民人身、財(cái)產(chǎn)造成巨大損失的同時(shí)更隱秘以及廉價(jià)。由于其發(fā)展勢(shì)頭迅猛,國(guó)際上還沒(méi)有相關(guān)文件對(duì)其進(jìn)行規(guī)制,目前只有區(qū)域組織與一些國(guó)家有相關(guān)立法,但這對(duì)于打擊國(guó)際性的網(wǎng)絡(luò)恐怖主義犯罪遠(yuǎn)遠(yuǎn)不夠。這就造成了網(wǎng)絡(luò)恐怖主義犯罪目前呈一種泛濫的趨勢(shì)。作為恐怖主義犯罪的一種形式,這種犯罪在世界范圍內(nèi)影響極其深遠(yuǎn),同時(shí)對(duì)國(guó)際反恐大方針的實(shí)施有一定的阻礙。因此在國(guó)際法層面上對(duì)其進(jìn)行規(guī)制是十分必要的。本文從分析國(guó)際上目前對(duì)網(wǎng)絡(luò)恐怖主義犯罪存在的盲點(diǎn)出發(fā),指出其不僅在對(duì)網(wǎng)絡(luò)恐怖主義犯罪的界定上存在盲點(diǎn),而且國(guó)際上缺失規(guī)制此類(lèi)犯罪的文件也是一處盲點(diǎn);由于這些盲點(diǎn)的存在,使得網(wǎng)絡(luò)恐怖主義犯罪目前呈現(xiàn)一種泛濫的趨勢(shì),各區(qū)域組織以及國(guó)家都積極通過(guò)相關(guān)立法對(duì)其進(jìn)行規(guī)制,這些給以國(guó)際法規(guī)制此類(lèi)犯罪提供了現(xiàn)實(shí)基礎(chǔ)。最后筆者提出自己對(duì)于如何用國(guó)際法規(guī)制此類(lèi)犯罪進(jìn)行規(guī)制的建議,主要有參考國(guó)際有關(guān)恐怖主義犯罪的立法同時(shí)結(jié)合各區(qū)域組織和國(guó)家的立法,制定一部達(dá)到制止網(wǎng)絡(luò)恐怖主義犯罪目的的國(guó)際公約,公約中包含但不限于給網(wǎng)絡(luò)恐怖主義犯罪下定義、管轄、締約國(guó)責(zé)任義務(wù)以及犯罪主體責(zé)任承擔(dān)等;同時(shí)世界范圍內(nèi)還應(yīng)當(dāng)加強(qiáng)國(guó)際司法協(xié)作,積極促進(jìn)引渡的達(dá)成以及進(jìn)行司法程序與技術(shù)協(xié)作的互助,爭(zhēng)取將國(guó)際網(wǎng)絡(luò)恐怖主義犯罪的危害降到最低。
[Abstract]:The crime of network terrorism is a new development mode of terrorist crime in the Internet era, and it is the combination of terrorism and network. This crime combines the characteristics of the Internet and retains the characteristics of terrorism. Making it more secret and cheaper while causing huge losses to the people and property of the world. Because of its rapid development, there are no relevant international documents regulating it. At present, only regional organizations and some countries have relevant legislation. However, this is far from enough to combat international cyberterrorism crimes. This has resulted in a proliferation of cyberterrorism crimes. As a form of terrorist crimes, The impact of this crime on a worldwide scale is extremely far-reaching, At the same time, there are some obstacles to the implementation of the international anti-terrorist policy. Therefore, it is necessary to regulate it on the level of international law. Pointing out that there are blind spots not only in the definition of the crime of cyberterrorism, but also in the absence of documents regulating such crimes in the international community; because of the existence of these blind spots, This makes the crime of cyberterrorism take on a trend of overflowing. All regional organizations and countries actively regulate it through relevant legislation. These provide a realistic basis for the regulation of such crimes by international law. Finally, the author puts forward some suggestions on how to regulate such crimes by international law. Referring mainly to international legislation on terrorist crimes and combining with the legislation of regional organizations and countries to develop an international convention for the suppression of cyberterrorism crimes, The Convention contains, but is not limited to, the definition of crimes of cyberterrorism, jurisdiction, the liability obligations of States parties and the liability of the subject of the crime; at the same time, international judicial cooperation should be strengthened worldwide, To actively promote extradition and mutual assistance in judicial proceedings and technical cooperation in order to minimize the harm of international cyberterrorism.
