國際集裝箱運輸中集裝箱缺陷引致貨損的法律責任承擔

【摘要】:20世紀60年代的海運集裝箱化是運輸業(yè)的一場革命,不僅使傳統(tǒng)的件雜貨班輪運輸逐步讓位于集裝箱運輸,而且使“港到港”的運輸很快延伸為“門到門”的服務,使得國際運輸能夠更好的適應不斷增加的國際貿(mào)易量的需求。在國際集裝箱運輸中,集裝箱的大量使用不僅有利于節(jié)省貨物的包裝費和倉儲費,提高貨物在港口的裝卸效率,加快船舶和陸運車輛的的周轉(zhuǎn)速度,而且集裝箱的使用也大大減少了貨損貨差,促進了國際多式聯(lián)運的發(fā)展。 然而,隨著集裝箱在海上貨物運輸中的大規(guī)模運用,由于它本身的特點即運量大、數(shù)額多、損失隱蔽等,使得國際集裝箱運輸中的貨損事故也逐年呈上升趨勢,尤其是集裝箱本身的缺陷導致的貨損問題(包括集裝箱自身的缺陷以及集裝箱不適合所裝運的貨物兩種情況),并且由于集裝箱本身的缺陷導致貨損情況下的責任承擔問題在法律上一直也沒有明確的認定規(guī)則。而我國海商法和相關其他法律法規(guī)以及國際公約大多數(shù)都是針對傳統(tǒng)的件雜貨運輸所設置的權利義務體系,對國際集裝箱運輸規(guī)定大多數(shù)也是針對多式聯(lián)運下承運人的責任制度等問題進行研究,而專門針對集裝箱本身缺陷導致貨損的規(guī)定并不健全,而在實踐中,此種問題卻越來越多的為法律界和實務界的人士所關注。本文正是基于此來論述國際集裝箱運輸中集裝箱缺陷引致貨損的責任承擔問題。 文章分為五個章節(jié)來進行論述,第一章簡要介紹了理論界對集裝箱的定義,以及集裝箱的性質(zhì)的主要觀點并對其進行了簡要的評述;第二章主要論述了集裝箱的不同提供者以及其法律關系的認定,并闡明了集裝箱性質(zhì)認定的意義;第三章主要論述了承運人提供集裝箱情況下承托雙方的責任分配問題;第四章主要論述了托運人提供集裝箱情況下的承托雙方的責任分配;第五章主要論述了為避免集裝箱缺陷引致貨損各方應采取的措施以及相應的立法建議。 筆者認為上述問題的梳理和解決,有利于集裝箱運輸?shù)捻樌M行和集裝箱缺陷導致貨損事故的處理,并且希望能夠?qū)H海上集裝箱運輸?shù)睦碚摵蛯嵺`的研究有所裨益。
[Abstract]:In 1960s, the containerization of seaborne was a revolution in the transportation industry, which not only made the traditional cargo liner transportation give way to the container transportation, but also made the port-to-port transportation quickly extend to the door-to-door service. In international container transportation, the large use of containers not only helps to save the packing and storage costs of goods, but also to improve the efficiency of loading and unloading of goods in ports. Speed up the turnover of ships and ground vehicles, and the use of containers has greatly reduced cargo damage, and promoted the development of international multimodal transport. However, with the large-scale use of containers in the sea cargo transportation, due to its own characteristics, such as large volume, large amount of transportation, hidden losses and so on, the number of damage accidents in international container transportation is on the rise year by year. In particular, the damage caused by the defects of the container itself (including the defects of the container itself and the fact that the container is not suitable for the goods shipped) and the liability in the case of damage due to the defects of the container itself. However, most of the maritime laws and other relevant laws and regulations of our country and international conventions are aimed at the traditional system of rights and obligations for the transportation of groceries. Most of the regulations on international container transport are also concerned with the liability system of the carrier under multimodal transport. However, the provisions which specifically aim at the damage caused by the defects of the container itself are not perfect, but in practice, This kind of problem is paid more and more attention by the legal profession and the practical profession. This paper is based on this to discuss the liability for damage caused by the container defect in the international container transportation. This paper is divided into five chapters to discuss. The first chapter briefly introduces the definition of container and the main viewpoints of the nature of container and makes a brief comment on it. The second chapter mainly discusses the different providers of containers and their legal relations, and clarifies the significance of the nature of the container, the third chapter mainly discusses the distribution of the responsibility of both parties in the case of container provided by the carrier. Chapter 4th mainly discusses the distribution of liability between the two parties in the case of shippers supplying containers, and Chapter 5th mainly discusses the measures that should be taken by the parties to avoid the damage caused by container defects and the corresponding legislative suggestions. The author thinks that combing and solving the above problems is beneficial to the smooth progress of container transportation and the handling of damage accidents caused by container defects, and hopes to be helpful to the study of the theory and practice of international maritime container transportation.
