【摘要】：作為和WTO所倡導的多邊貿(mào)易體制相抗衡的雙邊貿(mào)易體制的產(chǎn)物，以自由貿(mào)易區(qū)為主要代表的區(qū)域貿(mào)易安排近年來逐漸興起。伴隨著《中國－哥斯達黎加自由貿(mào)易協(xié)定》于2011年8月1日正式生效，我國已經(jīng)參與締結了十個自由貿(mào)易協(xié)定。而在自由貿(mào)易協(xié)定的締結過程中，貿(mào)易救濟措施，特別是其中保障措施如何安排一直是眾人關注的重點。本文即從自由貿(mào)易協(xié)定中的保障措施出發(fā)，對我國現(xiàn)階段訂立的自由貿(mào)易協(xié)定中的保障措施進行系統(tǒng)分析，進而提出構建我國自由貿(mào)易協(xié)定保障條款的建議。 本文主要分為三個部分。第一部分對于自由貿(mào)易協(xié)定中的保障措施進行介紹，對于在區(qū)域經(jīng)濟一體化背景下不同的自由貿(mào)易協(xié)定對于保障措施的不同安排進行探討，分為全球保障措施和雙邊保障措施兩個部分。第二部分集中討論自由貿(mào)易協(xié)定中的保障措施在WTO框架下的合法性問題，主要涉及GATT第24條與WTO法律框架下的緊張關系和實踐中WTO專家小組和上訴機構所創(chuàng)設的平行性原則兩個方面。而文章的最后一個部分集中探討我國參與的自由貿(mào)易協(xié)定中有關保障措施的具體安排，將我國現(xiàn)階段所參與的自由貿(mào)易協(xié)定分為三類，按類別逐一討論，而對于我國最早簽訂的中國－東盟自由貿(mào)易協(xié)定進行特別關注，也可嗅出我國之后所簽訂的自由貿(mào)易協(xié)定保障措施如此安排的原因。進行此探討分析的目的似為我國今后構建自由貿(mào)易協(xié)定保障措施條款所提供建議參考。 我國現(xiàn)階段參與的自由貿(mào)易協(xié)定大多與發(fā)展中國家締結，缺乏與發(fā)達國家之間進行自由貿(mào)易談判的機會，而相較于具備多年自由貿(mào)易協(xié)定談判經(jīng)驗的發(fā)達國家而言，我國在自由貿(mào)易協(xié)定締結方面尚顯稚嫩，如何在談判中利用保障措施維護自己的經(jīng)濟利益，對于因加入WTO而做出的貿(mào)易讓步進行最大程度的規(guī)避，最大程度地利用自由貿(mào)易協(xié)定參與國際間或區(qū)域間的經(jīng)濟貿(mào)易安排，實為我國現(xiàn)階段參與自由貿(mào)易協(xié)定談判進行保障措施安排所應該考量的重點。同時，作為發(fā)展中大國，在同其他發(fā)展中國家進行自由貿(mào)易協(xié)定締結和實踐的過程中，，如何恪守自由貿(mào)易協(xié)定下的既定義務，避免南方共同市場被少數(shù)大國操縱的覆轍，也是我國現(xiàn)階段所應該加以注意的。
[Abstract]:As a product of the bilateral trading system that competes with the multilateral trading system advocated by the WTO, Regional trade arrangements, mainly represented by free trade zones, have been emerging in recent years. Along with the entry into force of the Free Trade Agreement between China and Costa Rica on August 1st 2011, Our country has participated in the conclusion of ten free trade agreements. And in the process of concluding free trade agreements, trade relief measures, In particular, how to arrange the safeguard measures has always been the focus of attention. This paper, proceeding from the safeguard measures in the free trade agreements, makes a systematic analysis of the safeguards measures in the free trade agreements concluded by our country at this stage. And then put forward the proposal of constructing the safeguard clause of our free trade agreement. This paper is mainly divided into three parts. The first part introduces the safeguard measures in free trade agreements, and discusses the different arrangements of different free trade agreements for safeguard measures in the context of regional economic integration. The second part focuses on the legality of safeguards in free trade agreements under the framework of WTO. It mainly deals with the tension between Article 24 of GATT and the legal framework of WTO and the principle of parallelism created by the panel of experts of WTO and the appellate body in practice. The last part of the article focuses on the free trade in which China participates. Specific arrangements relating to safeguards in the Exchange Agreement, The free trade agreements to which China is a party at this stage are divided into three categories, discussed one by one by category, and special attention is paid to the China-ASEAN Free Trade Agreement, which was first signed by China. It is also possible to sniff out the reasons why the safeguard measures of the free trade agreements signed by China are so arranged. The purpose of this discussion and analysis seems to provide a reference for China to construct the safeguard measures of free trade agreements in the future. Most of the free trade agreements in which China is participating at this stage are concluded with developing countries, lacking opportunities for free trade negotiations with developed countries, compared with developed countries with many years of experience in free trade agreements negotiations. China is still young in the conclusion of free trade agreements, how to use safeguard measures to protect its economic interests in the negotiations, and to avoid the trade concessions made by China's accession to the WTO to the greatest extent. Maximizing the use of free trade agreements to participate in international or interregional economic and trade arrangements is indeed the focus of our country's consideration of safeguards arrangements for participating in the free trade agreement negotiations at this stage... at the same time, as a major developing country, In the process of concluding and implementing free trade agreements with other developing countries, how to adhere to established obligations under free trade agreements and to avoid the fate of Mercosur being manipulated by a small number of major Powers, Also should pay attention to at present stage of our country.
