【摘要】：歐洲人權(quán)機(jī)關(guān)對(duì)緊急狀態(tài)下人權(quán)的保障主要是圍繞著《歐洲人權(quán)公約》第15條所確立的標(biāo)準(zhǔn)進(jìn)行的實(shí)踐。該條不僅規(guī)定了緊急狀態(tài)的概念,還規(guī)定基本權(quán)利不得克減、克減措施與緊急狀態(tài)相稱、禁止歧視、與其他國際義務(wù)相一致等實(shí)質(zhì)性要件和履行國際通知的形式要件,從而對(duì)國家宣布緊急狀態(tài)和行使克減權(quán)作出了嚴(yán)格的限制。歐洲人權(quán)機(jī)關(guān)適用公約第15條的實(shí)踐不僅為緊急狀態(tài)下的人權(quán)提供了有效的救濟(jì)和保障,而且對(duì)于其他國際組織和國家具有重要的參考和借鑒意義。
[Abstract]:The protection of human rights in states of emergency by European human rights bodies is mainly based on the practice of the standards established in article 15 of the European Convention on Human Rights, which not only defines the concept of states of emergency. It also provides for the non-derogation of fundamental rights, the substantive elements of derogation measures commensurate with the state of emergency, the prohibition of discrimination, the compatibility with other international obligations and the formal elements for the implementation of international notification. Thus, the declaration of a state of emergency and the exercise of derogation powers are strictly restricted. The practice of the European Human Rights institutions in applying article 15 of the Convention not only provides effective relief and protection for human rights in states of emergency. And for other international organizations and countries have an important reference and reference significance.
