【摘要】：2006年3月15日,第60屆聯(lián)合國(guó)大會(huì)以170票贊成、4票反對(duì)、3票棄權(quán)的表決結(jié)果通過(guò)251號(hào)決議,決定設(shè)立新的人權(quán)理事會(huì)來(lái)處理聯(lián)合國(guó)系統(tǒng)內(nèi)部人權(quán)事務(wù),包括大規(guī)模地、系統(tǒng)地侵犯人權(quán)的行為。2006年6月19日,聯(lián)合國(guó)人權(quán)理事會(huì)首屆會(huì)議在瑞士日內(nèi)瓦舉行,宣告運(yùn)行60年的聯(lián)合國(guó)人權(quán)委員會(huì)的終結(jié),一個(gè)新的處理國(guó)際人權(quán)事務(wù)的機(jī)構(gòu)正式開(kāi)始運(yùn)作。目前(截止2011年3月),人權(quán)理事會(huì)共召開(kāi)了16屆會(huì)議和15屆特別會(huì)議。人權(quán)理事會(huì)還處于初級(jí)階段,研究者們從國(guó)際組織法的角度對(duì)人權(quán)理事會(huì)的研究還不夠深入。有鑒于此,筆者想從國(guó)際組織法的角度對(duì)聯(lián)合國(guó)人權(quán)理事會(huì)進(jìn)行透視。 本文共分為七章：第一章簡(jiǎn)要介紹本文的研究背景及意義、國(guó)內(nèi)外的研究現(xiàn)狀、本文的研究方法和創(chuàng)新之處；第二章人權(quán)理事會(huì)的前身：介紹人權(quán)委員會(huì)的設(shè)立背景、貢獻(xiàn)以及存在的不足、向人權(quán)理事會(huì)過(guò)渡；第三章是本文的重點(diǎn)章,主要從國(guó)際組織法的角度,進(jìn)一步闡述人權(quán)理事會(huì)的章程、人權(quán)理事會(huì)的設(shè)立目的和法律地位、人權(quán)理事會(huì)的成員國(guó)、人權(quán)理事的職能、人權(quán)理事會(huì)的議事規(guī)則等主要國(guó)際組織法問(wèn)題。第四章闡述人權(quán)理事會(huì)對(duì)人權(quán)委員會(huì)的繼受和革新；第五章對(duì)人權(quán)理事會(huì)四年多的實(shí)踐進(jìn)行綜述,即從人權(quán)理事會(huì)在國(guó)際人權(quán)立法、國(guó)際人權(quán)保護(hù)制度主要是對(duì)人權(quán)理事會(huì)的普遍定期審議機(jī)制進(jìn)行闡述,同時(shí)分析人權(quán)理事會(huì)所存在的問(wèn)題,并對(duì)人權(quán)理事會(huì)的前景進(jìn)行展望。第六章論述中國(guó)對(duì)人權(quán)理事會(huì)的貢獻(xiàn),以及中國(guó)自愿承擔(dān)的國(guó)際義務(wù)；第七章為結(jié)論,主要是嘗試探索人權(quán)理事會(huì)對(duì)國(guó)際組織法的影響。
[Abstract]:In March 15, 2006, the sixtieth session of the UN General Assembly by 170 votes in favor, 4 votes against, 3 abstentions passed resolution 251, decided to set up a new Human Rights Council to deal with human rights issues within the United Nations system, including large-scale, systematic violations of human rights.2006 in June 19th, the UN Human Rights Council meeting held in the first Geneva Switzerland, announce the end 60 years of operation of the United Nations Commission on human rights, an international human rights affairs agency new officially started operation. Currently (as of March 2011), the Human Rights Council convened the 16 session and the 15 special session of the human rights Council is still in the initial stage, the researchers from the international organization law study on the Human Rights Council is not deep enough. In view of this, the author wants to focus on the UN Human Rights Council from the international law angle.
This paper is divided into seven chapters: the first chapter the research background and significance are briefly introduced in this paper, the research status at home and abroad, research methods and innovations in this paper; the second chapter of the Human Rights Council predecessor: the establishment of background of the Commission on human rights, contributions and deficiencies, to the Human Rights Council transition; the third chapter is the key chapter of this paper the organization mainly from the international law angle, further elaborated the Human Rights Council's constitution, the Human Rights Council to set up and the legal status of the Human Rights Council member of the Human Rights Council, the functions of the human rights Council on the rules of the main international organization law. The fourth chapter of the Human Rights Council and following the reform of the Commission on human rights; the fifth chapter summarizes the practice of the Human Rights Council for more than four years, from the Human Rights Council on international human rights legislation and international human rights protection system mainly is the director of human rights The universal periodic review mechanism is expounded, and analysis of the existing Human Rights Council, and the Council's prospect. The sixth chapter discusses the contribution of the Human Rights Council China, and China international obligations voluntarily assumed; the seventh chapter is the conclusion, mainly attempts to explore the impact of Human Rights Council on international law.
