【摘要】：中國新舊政府的承認與繼承是特殊的政府承認與繼承問題,容易引發(fā)時際法律沖突。有效統(tǒng)治(實際控制)原則是確定政府繼承權(quán)的基礎(chǔ);"承認溯及既往"原則適用于一般的、不存在現(xiàn)實的時際法律沖突;"法不溯及既往"原則適用于特殊的、存在現(xiàn)實的時際法律沖突。"光華寮案"中,日本地方法院和高等法院未考慮實際控制原則,日本最高法院則錯誤地理解和適用了"承認溯及既往"的原則。聯(lián)大2758號決議達到了由新中國政府繼承舊中國政府在聯(lián)合國的所有地位及權(quán)利的目的,但提案措辭沒有充分考慮中國政府承認與繼承問題的特殊性,從而導致了法律漏洞的產(chǎn)生。
[Abstract]:The recognition and inheritance of Chinese new and old governments is a special problem of government recognition and inheritance, which is liable to lead to the conflict of laws between time and time. The principle of effective rule (actual control) is the basis of determining the government's inheritance rights. The principle of "recognition of retroactivity" applies to general and non-existent intertemporal conflicts of laws; The principle of "non-retroactivity of law" is applicable to special and practical intertemporal conflicts of laws. In the Guanghuaoliao case, the Japanese District Court and the High Court did not consider the principle of actual control. For its part, the Supreme Court of Japan misinterpreted and applied the principle of "recognition of retroactivity". General Assembly Resolution 2758 achieved the purpose of the New China Government inheriting all the status and rights of the old Chinese Government in the United Nations. However, the wording of the proposal did not fully take into account the particularity of the Chinese government's recognition and succession, which led to the legal loophole.
