【摘要】：商標法中的"相關公眾"、專利法中的"本領域普通技術人員"及版權法實踐中的"普通觀察者或聽眾"等擬制人格與傳統(tǒng)法律上的"理性人"概念在構成和功能上無實質(zhì)性差異,在學理和實踐中經(jīng)常被視為知識產(chǎn)權法語境下之"理性人"。分散于知識產(chǎn)權法不同領域中的理性人標準具有極多共性成分,"公因式"的提取可以為其適用提供更為簡便和協(xié)調(diào)的路徑。理性人標準適用于客體適格性確定、侵權判定及權利解釋等知識產(chǎn)權法領域。在對知識產(chǎn)權法中理性人進行擬制時,應考慮所屬群體范圍、認知水平及時間選擇等要素。知識產(chǎn)權政策目標定位和圍繞著知識產(chǎn)品的"物化"環(huán)境兩個因素影響著知識產(chǎn)權法中理性人標準的確定。實際判斷者與理性人之間認知偏差的矯正以及理性人標準的類型化是解決我國知識產(chǎn)權法中理性人標準"客觀化"障礙的主要路徑。
[Abstract]:The "relevant public" in trademark law. There is no substantial difference in constitution and function between the fictitious personality such as "ordinary technician in this field" and "ordinary observer or audience" in the practice of copyright law and the concept of "rational person" in traditional law. In theory and practice, it is often regarded as "rational person" in the context of intellectual property law. The standard of rational person scattered in different fields of intellectual property law has many common elements. The extraction of "common factor" can provide a more convenient and coordinated path for its application. The standard of rational person is applicable to the determination of object suitability. In the field of intellectual property law, such as tort judgment and interpretation of rights, the scope of the group should be considered when the rational person in intellectual property law is fictitious. Factors such as cognitive level and time choice. Orientation of intellectual property policy objectives and materialization around knowledge products. Two factors of environment affect the determination of the standard of rational person in intellectual property law. The correction of cognitive deviation between the practical judge and the rational person and the classification of the standard of rational person are the solutions to the standard of rational person in intellectual property law of our country.
