【摘要】：腐敗問題日益嚴重，已經(jīng)危害到世界各國的經(jīng)濟發(fā)展和民主法治，侵蝕著世界的每個角落。20世紀90年代，，自透明國際首次提出的腐敗名冊在世界范圍內(nèi)引起轟動開始，人們開始逐步認清腐敗給人類社會進步帶來的巨大的危害。接下來的十幾年間，全球掀起了一股反腐敗的熱潮。各國際組織先后制定了與自身職能緊密相關(guān)的反腐敗政策與措施，為各國的反腐敗行動提供了豐富的經(jīng)驗，也為各國反腐敗機制的完善提供了制度參考。我國作為一個腐敗案件頻發(fā)的發(fā)展中國家，腐敗嚴重危害著我國的經(jīng)濟發(fā)展和社會穩(wěn)定，因此我們應該將反腐敗作為一項長期而艱巨的任務進行到底，構(gòu)建綜合、協(xié)調(diào)、高效的反腐敗機制。 作為亞洲地區(qū)開發(fā)基金的主要來源機構(gòu)，亞洲開發(fā)銀行將腐敗視作經(jīng)濟與社會發(fā)展的最大障礙，并充分利用自身在金融資源配置中的核心作用，致力于遏制腐敗，并取得了良好的預防和懲治腐敗的效果。因此對亞洲開發(fā)銀行反腐敗機制做系統(tǒng)分析，為完善我國相關(guān)領(lǐng)域反腐敗法律機制的提供了一個新的視角。 亞洲開發(fā)銀行進行反腐敗活動旨在減少廣泛、系統(tǒng)性的腐敗對亞太地區(qū)經(jīng)濟發(fā)展和亞行發(fā)展中成員體發(fā)展的影響，是對亞行成立宗旨的實現(xiàn)，也是對國際社會反腐敗戰(zhàn)略的響應。亞洲開發(fā)銀行的反腐敗機制，就是在國際社會反腐敗呼吁和成員國反腐敗訴求的雙重推動下產(chǎn)生的。亞洲開發(fā)銀行的反腐敗機制由反腐敗實體規(guī)范及程序規(guī)范構(gòu)成。其中，《亞洲開發(fā)銀行反腐敗政策》（ADB’sAnticorruption Policy）是整個反腐敗機制的核心，實體規(guī)范及程序規(guī)范圍繞《反腐敗政策》所提出的三個反腐敗目標而產(chǎn)生，并根據(jù)《反腐敗政策》的要求不斷修訂和完善。具體而言，反腐敗實體規(guī)范主要包含在亞洲開發(fā)銀行的貸款規(guī)則、采購規(guī)則以及反洗錢政策中。這些規(guī)則和政策屬于國際慣例的范疇，對成員國不具有普遍適用性和強制約束力，但成員國一旦參與亞行援助或資助的項目，就應當遵循亞行的政策。在實體規(guī)范出臺之后，亞行又制定了相應的內(nèi)部報告及調(diào)查程序，以及制裁程序，以保障規(guī)范在區(qū)域范圍和自身機構(gòu)內(nèi)部的實際運作。 亞行反腐敗機制的積極效果，對我國銀行業(yè)金融機構(gòu)反腐敗活動的開展有一定的借鑒意義，同時也為我國政府采購反腐敗機制的完善有良好的示范作用。
[Abstract]:The problem of corruption is becoming more and more serious, which has jeopardized the economic development and democracy and the rule of law in every country, eroding every corner of the world in 90s. Since Transparency International first put forward the corruption roster in the world caused a sensation, people began to gradually recognize corruption to human social progress brought great harm. The next decade. International organizations have formulated anti-corruption policies and measures closely related to their own functions, which provide rich experience for the anti-corruption action of various countries. As a developing country with frequent corruption cases, corruption seriously endangers our economic development and social stability. Therefore, we should take anti-corruption as a long-term and arduous task to build a comprehensive, coordinated and efficient anti-corruption mechanism. As the main source of the Asian regional development fund, the Asian Development Bank sees corruption as the biggest obstacle to economic and social development and takes full advantage of its central role in the allocation of financial resources. Committed to curb corruption and achieved good results in the prevention and punishment of corruption. Therefore, the Asian Development Bank anti-corruption mechanism is systematically analyzed. It provides a new angle of view for perfecting the anti-corruption legal mechanism in related fields of our country. The Asian Development Bank's anti-corruption activities are aimed at reducing the impact of widespread and systematic corruption on the economic development of the Asia-Pacific region and on the development of the developing members of the Asian Development Bank. It is the realization of the founding purpose of the Asian Development Bank. It is also a response to the anti-corruption strategy of the international community. Anti-Corruption Mechanism of the Asian Development Bank. The anti-corruption mechanism of Asian Development Bank is composed of anti-corruption entity norms and procedural norms. The Anti-Corruption Policy of the Asian Development Bank (ADBs Anticorption Policy) is the core of the whole anti-corruption mechanism. Substantive and procedural norms have emerged around the three anti-corruption objectives set forth in the Anti-Corruption Policy, and have been continuously revised and improved in accordance with the requirements of the Anti-Corruption Policy. The anti-corruption entity norms are mainly contained in the lending rules, procurement rules and anti-money-laundering policies of the Asian Development Bank. These rules and policies fall within the scope of international practice. They are not universally applicable and binding on member States, but once they are involved in ADB aid or funded projects, they should follow ADB policies. The ADB has also developed internal reporting and investigation procedures, as well as sanctions procedures, to ensure that the norms operate on a regional scale and within their own institutions. The positive effect of the anti-corruption mechanism of ADB has some referential significance for the development of anti-corruption activities of banking financial institutions in our country, and it also has a good demonstration function for the perfection of anti-corruption mechanism of our country's government procurement
