【摘要】:國(guó)際海上貨物運(yùn)輸是指使用船舶通過(guò)海上航道在不同國(guó)家和地區(qū)的港口之間運(yùn)送貨物的一種運(yùn)輸方式,其以運(yùn)輸量大、通過(guò)能力強(qiáng)、運(yùn)費(fèi)低廉、對(duì)貨物適應(yīng)性強(qiáng)等優(yōu)勢(shì),占據(jù)著國(guó)際貨物運(yùn)輸?shù)闹饕匚。根?jù)統(tǒng)計(jì),國(guó)際貨物總運(yùn)量的75%以上通過(guò)海上運(yùn)輸完成,而我國(guó)進(jìn)出口貨物總運(yùn)量有80%至90%是通過(guò)海上運(yùn)輸方式進(jìn)行的。由此,國(guó)際海上貨物運(yùn)輸作為涉及面最廣、使用率最高的運(yùn)輸方式,對(duì)參與該種運(yùn)輸?shù)闹黧w的法律地位、法律關(guān)系、法律責(zé)任等方面的研究顯得尤其重要。 從研究?jī)r(jià)值的角度來(lái)看,這項(xiàng)研究具有非,F(xiàn)實(shí)的意義:其一,為我國(guó)國(guó)內(nèi)從事國(guó)際海上貨物運(yùn)輸?shù)墓尽⑵髽I(yè)提供風(fēng)險(xiǎn)防范和利益保護(hù)的法律指導(dǎo),使其在明確其法律地位的前提下審慎開(kāi)展相應(yīng)的業(yè)務(wù)操作;其二,為我國(guó)國(guó)際海上貨物運(yùn)輸糾紛案件的審判提供理論層面的依據(jù)和建議,在正確識(shí)別當(dāng)事人主體地位的前提下正確確定相關(guān)責(zé)任人的責(zé)任范圍;其三,為我國(guó)國(guó)際海上貨物運(yùn)輸合作法律環(huán)境的改善提供理論依據(jù)。 本文的目的是,通過(guò)對(duì)我國(guó)有關(guān)國(guó)際海上貨物運(yùn)輸法律法規(guī)等規(guī)范性文件的分析、研究,并參照有關(guān)國(guó)際海上貨物運(yùn)輸?shù)膰?guó)際公約、國(guó)際規(guī)則,對(duì)參與國(guó)際海上貨物運(yùn)輸過(guò)程中各個(gè)主體逐個(gè)進(jìn)行辨析,厘清各主體在國(guó)際海上貨物運(yùn)輸過(guò)程中的地位、權(quán)利、義務(wù)、責(zé)任,明確現(xiàn)行法律法規(guī)的優(yōu)勢(shì)與缺陷,并據(jù)此對(duì)國(guó)內(nèi)相關(guān)立法提供合理化、建設(shè)性的意見(jiàn)。
[Abstract]:International carriage of goods by sea refers to the use of ships to transport goods between ports of different countries and regions through the sea channel, which is characterized by large volume of transport, strong capacity of passage and low freight. According to statistics, more than 75% of the total volume of international cargo is carried out by sea. The total volume of import and export cargo in China is 80% to 90% by sea transportation. Therefore, international maritime cargo transport is the most extensive and most utilized mode of transport. It is particularly important to study the legal status, legal relationship and legal liability of the subjects involved in this kind of transportation. From the perspective of the value of the study, this study has a very practical significance: first, for our domestic companies engaged in the international carriage of goods by sea, enterprises to provide risk prevention and interests protection legal guidance. Make it in clear its legal status under the premise of prudently carry out the corresponding business operations; Second, to provide theoretical basis and suggestions for the trial of disputes over international carriage of goods by sea in China, and to correctly determine the scope of responsibility of relevant responsible persons on the premise of correctly identifying the principal position of the parties concerned; Third, it provides the theoretical basis for the improvement of the legal environment of our country's international cooperation in the carriage of goods by sea. The purpose of this paper is to analyze and study the relevant laws and regulations of international carriage of goods by sea in China, and to refer to the international conventions and rules of international carriage of goods by sea. In the process of participating in the international carriage of goods by sea, the author distinguishes each subject one by one, clarifies the status, rights, obligations and responsibilities of each subject in the process of international carriage of goods by sea, and clarifies the advantages and disadvantages of the current laws and regulations. And accordingly provides the rationalization to the domestic related legislation, the constructive opinion.
