【摘要】：經過長達十年的醞釀和協商,我國終于在2010年1月1日與東南亞國家聯盟建成了中國-東盟自由貿易區(qū)。作為中國參與建立的第一個也是目前最大的發(fā)展中國家組成的自由貿易區(qū),它的建成無疑將對我國經濟乃至政治、文化等方面產生很大的影響,特別是隨著對東盟經貿數量的增長、貿易糾紛的增多,中國-東盟自由貿易區(qū)的爭端解決機制顯得越來越重要,它的價值也日益被人們所認識。鑒于此,本文擬從時代發(fā)展要求、中國東盟發(fā)展的特殊性、對現有爭端解決機制的分析等角度對中國-東盟自由貿易區(qū)的爭端解決機制進行研究和探討。 本文從我國與東盟國家的貿易現狀著手,分析了我國目前對中國-東盟自貿區(qū)爭端解決機制的研究現狀,剖析了該爭端解決機制機制產生的歷史背景、法律淵源,闡述了該爭端解決機制的主要內容,運用對比分析理論對該機制與世界貿易組織爭端解決機制在磋商、調停和調解、仲裁等方面進行了比較,在適用范圍、排他管轄權、使用主體、磋商、仲裁員指定、仲裁機構設立、起訴時間等方面與北美自由貿易區(qū)爭端解決機制進行了比較,論述了中國-東盟自貿區(qū)爭端解決機制的積極作用、不足之處、完善建議以及該機制對我國的影響和我國的應對措施,著重從五方面提出了我國應對中國-東盟自貿區(qū)爭端解決機制的對策,以期能對我國的經濟社會建設增磚添瓦。 目前我國對中國-東盟自貿區(qū)爭端解決機制的研究還處于起步階段,學術成果很有限,而且該機制面臨著許多新問題,是一個值得深入研究的課題,研究和使用前景很是廣泛。本文通過該課題的研究,力爭使該爭端解決機制能更好地發(fā)揮出它在處理中國東盟國際貿易爭端方面的積極作用,切實維護我國與東盟國家交往中的正當權益,也為今后我國對東盟的經濟交往、正在醞釀的中日韓自由貿易區(qū)建設、正在建設的中國非洲自由貿易區(qū)建設提供有益的借鑒。
[Abstract]:After ten years of deliberation and negotiation. In January 1st 2010, China finally established the China-ASEAN Free Trade area with the Association of Southeast Asian Nations. Its completion will undoubtedly have a great impact on the economy, politics, culture and other aspects of our country, especially with the increase of economic and trade with ASEAN, the increase of trade disputes. The dispute settlement mechanism of China-ASEAN Free Trade area is becoming more and more important, and its value is increasingly recognized by people. In view of this, this paper intends to meet the requirements of the development of the times, and the particularity of the development of China-ASEAN. This paper studies and discusses the dispute settlement mechanism of China-ASEAN Free Trade area from the point of view of analyzing the existing dispute settlement mechanism. This paper begins with the current situation of trade between China and ASEAN countries, analyzes the current situation of China's research on the dispute settlement mechanism of China-ASEAN Free Trade area, and analyzes the historical background of the dispute settlement mechanism. The source of the law, the main content of the dispute settlement mechanism, the use of comparative analysis of the mechanism and the World Trade Organization dispute settlement mechanism in consultation, mediation and mediation, arbitration and other aspects of comparison. In the scope of application, exclusive jurisdiction, subject of use, consultation, appointment of arbitrators, establishment of arbitration institution, time of prosecution and so on, this paper compares with the dispute settlement mechanism of North American Free Trade area (NAFTA). This paper discusses the positive role of the dispute settlement mechanism of the China-ASEAN Free Trade area, its shortcomings, the suggestions for its perfection, and the impact of the mechanism on our country and the measures to deal with it. This paper puts forward the countermeasures for China to deal with the dispute settlement mechanism of China-ASEAN Free Trade area from five aspects in order to increase the economic and social construction of our country. At present, the research on the dispute settlement mechanism of China-ASEAN Free Trade area is still in its infancy, the academic achievements are very limited, and the mechanism is faced with many new problems, which is a subject worthy of further study. The prospect of research and application is very extensive. Through the research of this topic, this paper tries to make the dispute settlement mechanism play an active role in dealing with the international trade dispute between China and ASEAN. To safeguard the legitimate rights and interests of China's exchanges with ASEAN countries and to build a China-Japan-ROK free trade zone for future economic exchanges between China and ASEAN. The construction of China-Africa Free Trade area under construction provides useful reference.
