【摘要】：我國與周邊國家的海域權(quán)索爭(zhēng)端在當(dāng)代凸顯出國際化、政治化、意識(shí)形態(tài)化和無序化的特征。我國作為爭(zhēng)端核心國在權(quán)索主張的法理根據(jù)上存在并用自然主義與歷史主義的矛盾。以意思自治和最密切聯(lián)系為核心的沖突法方略可以有效實(shí)現(xiàn)這種自然主義與歷史主義的融合,有助于我國與周邊國家海域權(quán)索爭(zhēng)端的解決。作為規(guī)則,沖突法的有效性是有限的;作為方案,沖突法的有限性則是有效的。沖突法的自律本性及其二級(jí)思維對(duì)包括海域權(quán)索在內(nèi)的一切爭(zhēng)端有無限有效性。意思自治、最密切聯(lián)系以及立足自律之上的二級(jí)共識(shí),三者構(gòu)成我國海域權(quán)索問題的綜合解決方案。
[Abstract]:The maritime dispute between China and the surrounding countries shows the characteristics of internationalization, politicization, ideology and disordering. China, as the core country of the dispute, exists in the jurisprudential basis of the claim of the right and uses the contradiction between naturalism and historicism. The strategy of conflict of laws with the core of autonomy and the most close relationship can effectively achieve the integration of naturalism and historicism, and help to solve the dispute of maritime claims between China and neighboring countries. As a rule, the effectiveness of the conflict of laws is limited; as a scheme, the finiteness of the conflict of laws is effective. The self disciplined nature of the law of conflict and its two level thought are of unlimited validity to all disputes, including the rights and cables of the sea area. The two level consensus on autonomy, the most close connection and the self-discipline, and the three are the comprehensive solutions to the issue of maritime rights and cables in China.
