【摘要】： 中央銀行、火和輪子并稱為自開天辟地以來的三大發(fā)明1,中央銀行產(chǎn)生及發(fā)展的歷史為這一結(jié)論提供了依據(jù)。隨著金融國際化進(jìn)程的加速,中央銀行在國際金融領(lǐng)域發(fā)揮著重要作用。此前,在由美國次貸危機(jī)所引發(fā)的全球金融危機(jī)中,各國中央銀行紛紛出臺(tái)救市措施,抑制金融危機(jī)影響范圍,維護(hù)金融穩(wěn)定。中央銀行作為具有特殊法律地位的金融機(jī)構(gòu),以中央銀行法律制度為根本的活動(dòng)準(zhǔn)則;尤其在應(yīng)對(duì)金融危機(jī)的形勢下,更要依法制定反危機(jī)措施。本文以此為契機(jī),通過分析俄羅斯中央銀行法律制度,并與中國中央銀行法律制度作比較,反思中國現(xiàn)行中央銀行法律制度的缺陷,為進(jìn)一步完善中國中央銀行法律制度提供法律理論及實(shí)踐支持。 本論文采用法解釋學(xué)、比較分析和歷史分析等方法,就俄羅斯中央銀行若干重要法律制度進(jìn)行梳理,在此基礎(chǔ)上就中國和俄羅斯兩國的中央銀行法律制度進(jìn)行比較、分析,分別涉及俄羅斯中央銀行的法律地位、俄羅斯中央銀行職能等方面,并探討法定職能之間的關(guān)系以及職能變革問題。通過比較、分析,明確中俄現(xiàn)行中央銀行法律制度存在的共性和差異:俄羅斯與中國在地理位置上相互毗鄰,且同為經(jīng)濟(jì)轉(zhuǎn)軌國家;但兩國的中央銀行法律制度無論是中央銀行的法律地位還是職能發(fā)揮等方面都存在相當(dāng)大的差異�！八街�,可以攻玉”,借鑒其法律制度中的合理部分,借以完善中國的中央銀行法律制度,以促進(jìn)中國金融業(yè)健康發(fā)展。
[Abstract]:The central bank, fire and wheel are known as the three great inventions since the beginning of the world, and the history of the emergence and development of the central bank provides the basis for this conclusion.With the acceleration of the financial internationalization process, the central bank plays an important role in the international financial field.Earlier, in the global financial crisis triggered by the U.S. subprime mortgage crisis, central banks of various countries have introduced rescue measures to curb the scope of the financial crisis and maintain financial stability.The central bank, as a financial institution with special legal status, takes the legal system of the central bank as the basic activity criterion, especially in the situation of responding to the financial crisis, it should formulate anti-crisis measures in accordance with the law.By analyzing the legal system of the Central Bank of Russia and comparing it with the legal system of the Central Bank of China, this paper reflects on the defects of the current legal system of the Central Bank of China.To further improve the legal system of the Central Bank of China to provide legal theory and practical support.This paper uses the methods of legal hermeneutics, comparative analysis and historical analysis to sort out some important legal systems of the Central Bank of Russia, and on this basis, to compare and analyze the legal systems of the central banks of China and Russia.It deals with the legal status of the Central Bank of Russia and the functions of the Central Bank of Russia respectively, and probes into the relationship between the legal functions and the reform of the functions.Through comparison and analysis, it is clear that there are commonness and differences in the current legal system of central bank between China and Russia: Russia and China are adjacent to each other in their geographical position, and they are both countries of economic transition;However, the legal system of the central bank of the two countries is quite different in legal status and function of the central bank.In order to perfect the legal system of China's central bank and promote the healthy development of China's financial industry, we can learn from the reasonable part of its legal system.
