【摘要】： 進(jìn)入20世紀(jì)以來(lái),人類社會(huì)組織化程度的不斷提高,犯罪的組織化程度也明顯加強(qiáng),黑社會(huì)組織犯罪逐漸成為人們關(guān)注的焦點(diǎn)。我國(guó)和其他國(guó)家雖然對(duì)黑社會(huì)組織犯罪進(jìn)行了一定數(shù)量的立法,但效果甚微,黑社會(huì)組織的發(fā)展勢(shì)頭不但沒(méi)有被遏制,隨著國(guó)際化進(jìn)程大有呈現(xiàn)出跨國(guó)發(fā)展的趨勢(shì)。 俄羅斯作為世界上黑社會(huì)組織犯罪最猖獗的國(guó)家之一,無(wú)論是從俄羅的國(guó)情還是從俄羅斯的時(shí)代變遷的社會(huì)背景、地緣關(guān)系去考慮俄羅斯的黑社會(huì)組織犯罪,與我國(guó)的黑社會(huì)組織犯罪相比都有其相似性,但是由于我國(guó)與俄羅斯在政治、經(jīng)濟(jì)、文化等影響黑社會(huì)組織犯罪的各種因素上的存在差異,中國(guó)與俄羅斯的黑社會(huì)組織組在歷史發(fā)展、組織化程度、組織結(jié)構(gòu)、社會(huì)危害性以及立法狀況等方面都存在較大的差異。 本文首先對(duì)黑社會(huì)組織的概念進(jìn)行了界定,并系統(tǒng)的闡述了黑社會(huì)組織犯罪、黑社會(huì)性質(zhì)組織犯罪以及有組織犯罪的關(guān)系,其次,對(duì)中國(guó)與俄羅斯黑社會(huì)組織犯罪的歷史、現(xiàn)狀以及發(fā)展?fàn)顩r進(jìn)行了論述,再者,從中國(guó)與俄羅斯黑社會(huì)組織的發(fā)展?fàn)顩r、組織化程度、組織結(jié)構(gòu)、活動(dòng)范圍、社會(huì)背景以及立法狀況進(jìn)行比較分析,為完善中國(guó)對(duì)黑社會(huì)組織犯罪的懲治和預(yù)防對(duì)策提供理論支持,最后從完善立法并增加財(cái)產(chǎn)刑、增設(shè)黑社會(huì)性質(zhì)組織犯罪的罪名并加重法定刑、完善證據(jù)制度、建立專門的反黑社會(huì)組織機(jī)構(gòu)四個(gè)方面為我懲治和預(yù)防黑社會(huì)組織犯罪提出了建議。
[Abstract]:Since the 20th century, the degree of human society's organization has been improved, and the degree of organized crime is obviously enhanced, and the crime of the underworld is gradually becoming the focus of people's attention. Although China and other countries have made a certain number of legislation on the crime of the underworld, the effect is very little, and the development momentum of the underworld organization has not been contained. As one of the most rampant crimes in the world, Russia is one of the most rampant crimes in the world, whether from the national condition of Russia or the social background of the transition from the time of Russia, to consider the criminal of the underworld of Russia, and to have it compared with the crime of the underworld of our country. On the basis of the differences between China and Russia on various factors, such as politics, economy, culture and so on, China and Russia's underworld organizations group have a historical development, a degree of organization and a group. The weaving structure, the social harmfulness, the legislative situation and so on exist. The article first defines the concept of the underworld, and expounds the relationship between the crime of the underworld, the organized crime of the underworld and the organized crime, and then the history, the present situation and the development of the crime of the Chinese and Russian underworld. The situation is discussed, and the development status, organization degree, organization structure, activity scope, social background and the legislative situation of the Chinese and Russian underworld organizations are compared and analyzed, so as to improve the punishment and prevention of the crime of the underworld organized by China. To provide theoretical support, in the end, we will punish and prevent the underworld organizations from the four aspects of perfecting the legislation and increasing the penalty of property, the addition of the crime of organized crime of the underworld and the law punishment, the improvement of the evidence system, the establishment of a special anti-triad organization.
