【摘要】：隨著社會的不斷進(jìn)步和發(fā)展,刑罰的輕緩化變革運動蓬勃發(fā)展。特別是20世紀(jì)60年代以來,監(jiān)禁刑越來越被罰金刑、社區(qū)矯正等更輕緩、更人道的非監(jiān)禁制裁措施所取代。目前,西方發(fā)達(dá)國家在刑罰適用方面已經(jīng)進(jìn)入了以非監(jiān)禁刑為主的階段。社區(qū)矯正,也被稱為社區(qū)處遇、社會內(nèi)處遇、機構(gòu)外處遇,是相對于傳統(tǒng)的監(jiān)禁處遇而言的一種罪犯處遇方式。社區(qū)矯正體系中的某些具體制度,比如緩刑和假釋,在西方已經(jīng)有百多年的發(fā)展歷史。但現(xiàn)代社區(qū)矯正成為系統(tǒng)的思想是在二戰(zhàn)以后,并于20世紀(jì)60年代以后快速發(fā)展,成為不可或缺的犯罪矯正措施,在世界范圍內(nèi)得到廣泛應(yīng)用。 2003年7月10日,為了貫徹落實我國寬嚴(yán)相濟(jì)的刑事政策,最高人民法院、最高人民檢察院、公安部、司法部等四部門發(fā)布《關(guān)于開展社區(qū)矯正試點工作的通知》,正式啟動社區(qū)矯正試點工作。2009年9月2日,為了推動我國社區(qū)矯正工作深入發(fā)展,四部門發(fā)布了《關(guān)于在全國試行社區(qū)矯正工作的意見》。應(yīng)該說,我國的社區(qū)矯正還正處于起步和探索階段,雖然取得了一些經(jīng)驗和成效,但是理論中的困惑和實踐中的問題還相當(dāng)多,還有很多方面需要完善和改進(jìn)。同時,社區(qū)矯正作為我國刑罰制度改革的一項重要舉措,它的推進(jìn)和發(fā)展必將對我國的刑事政策產(chǎn)生長期和深遠(yuǎn)的影響。在這樣的背景下,加強對社區(qū)矯正的理論研究和實踐探索顯得尤其必要和迫切。本文針對我國目前社區(qū)矯正適用率較低的情況,采用比較的、思辨的、理論結(jié)合實際的綜合方法,嘗試對我國和其他國家社區(qū)矯正的適用情況進(jìn)行全面而深入的研究,試圖為我國社區(qū)矯正適用率的提高提出有價值的意見和建議,探索我國社區(qū)矯正制度發(fā)展的路徑,以推動我國社區(qū)矯正工作更好更快發(fā)展。 本文主要從三個部分進(jìn)行闡述。第一部分對目前世界上三種主要的社區(qū)矯正模式的矯正對象進(jìn)行綜合分析,研究它們的不同點和相同點。第二部分介紹我國目前社區(qū)矯正的實際情況,分析我國目前社區(qū)矯正適用率較低的原因,并對調(diào)整社區(qū)矯正適用的必要性進(jìn)行研究。第三部分對我國社區(qū)矯正適用的調(diào)整提出前瞻構(gòu)想,希望通過完善現(xiàn)有的制度和增加新的制度來提高我國社區(qū)矯正的適用率。
[Abstract]:With the continuous progress and development of the society, the slow-down reform movement of penalty flourished. Especially since the 1960s, imprisonment has been replaced by fines, community correction and other lighter and more humane non-custodial sanctions. At present, the western developed countries have entered the stage of non-imprisonment penalty in penalty application. Community correction, also known as community treatment, social treatment, institutional treatment, compared with the traditional prison treatment of a criminal treatment. Some specific systems in the community correction system, such as probation and parole, have a history of more than 100 years in the West. But the idea that modern community correction became systematic was developed rapidly after the second world war and developed rapidly after the 1960s. It has become an indispensable measure of crime correction and has been widely used in the world. On 10 July 2003, in order to implement the criminal policy of combining leniency and severity, the Supreme people's Court, the Supreme people's Procuratorate, the Ministry of Public Security, The Ministry of Justice and other four departments issued the Circular on the pilot work of Community Correction, which officially launched the pilot work of Community Correction. On September 2, 2009, in order to promote the in-depth development of community correction work in China, The four departments issued the opinions on the trial of Community Corrections nationwide. It should be said that the community correction in our country is still in the beginning and exploration stage. Although some experiences and achievements have been obtained, there are still many theoretical puzzles and practical problems, and many aspects need to be perfected and improved. At the same time, as an important measure in the reform of our penal system, community correction will have a long-term and far-reaching impact on our country's criminal policy. Against this background, it is particularly necessary and urgent to strengthen the theoretical and practical research on community correction. Aiming at the low rate of application of community correction in our country, this paper attempts to make a comprehensive and in-depth study on the application of community correction in our country and other countries by using a comprehensive method of comparative, speculative, theoretical and practical application. This paper attempts to put forward valuable opinions and suggestions for the improvement of the application rate of community correction in our country, and to explore the path of the development of community correction system in our country, in order to promote the better and faster development of the community correction work in our country. This article mainly carries on the elaboration from three parts. The first part makes a comprehensive analysis of the correction objects of the three major community correction models in the world, and studies their differences and similarities. The second part introduces the actual situation of community correction in our country, analyzes the reasons for the low application rate of community correction in our country, and studies the necessity of adjusting the application of community correction. In the third part, the author puts forward a prospective idea on the adjustment of the application of community correction in China, hoping to improve the application rate of community correction by perfecting the existing system and adding new system.
