【摘要】: 勞動(dòng)教養(yǎng)是針對(duì)違法和輕微犯罪人員所采取的一項(xiàng)強(qiáng)制性教育改造措施,同時(shí)也是我國打擊違法犯罪的重要法律手段之一,它是在社會(huì)主義法律體系建設(shè)過程中所形成的一項(xiàng)具有鮮明中國特色的法律制度。毋庸置疑,在勞動(dòng)教養(yǎng)制度創(chuàng)立伊始,它為我國當(dāng)時(shí)的治安環(huán)境以及社會(huì)穩(wěn)定作出了重要貢獻(xiàn),經(jīng)過50多年的不斷發(fā)展,勞動(dòng)教養(yǎng)制度已經(jīng)成為我國社會(huì)主義法律體系中一個(gè)不可分割的重要組成部分。然而,時(shí)至今日,該項(xiàng)制度在運(yùn)行中逐漸表現(xiàn)出與當(dāng)今法制建設(shè)不相適應(yīng)的一面,種種弊端和缺陷也暴露無遺,嚴(yán)重影響了我國的法治進(jìn)程,如果對(duì)現(xiàn)今的勞動(dòng)教養(yǎng)制度聽之任之,必將影響我國“依法治國”重大戰(zhàn)略的實(shí)現(xiàn)。 本文在結(jié)構(gòu)上共分為四大部分,共計(jì)3萬余字。 第一部分是勞動(dòng)教養(yǎng)制度的歷史沿革與現(xiàn)狀。這一部分著重介紹了兩個(gè)問題,首先是勞動(dòng)教養(yǎng)制度的歷史沿革,主要闡述勞動(dòng)教養(yǎng)制度誕生的歷史背景及發(fā)展歷程,進(jìn)而揭示了該制度創(chuàng)建伊始的特殊社會(huì)政治環(huán)境與鮮明的時(shí)代意義。其次是勞動(dòng)教養(yǎng)制度的現(xiàn)狀,主要從勞動(dòng)教養(yǎng)的立法現(xiàn)狀、適用條件、適用程序和執(zhí)行期限等方面論述現(xiàn)今勞動(dòng)教養(yǎng)制度的概況,使讀者對(duì)我國現(xiàn)行的勞動(dòng)教養(yǎng)制度有一個(gè)清晰的了解,并為下文第二部分“勞動(dòng)教養(yǎng)與相關(guān)制度的比較”和第三部分“勞動(dòng)教養(yǎng)的弊端及缺陷分析”做鋪墊。 第二部分是勞動(dòng)教養(yǎng)與相關(guān)制度的比較。這一部分首先論述了勞動(dòng)教養(yǎng)與勞動(dòng)改造的異同點(diǎn),著重從性質(zhì)、目的、適用對(duì)象、適用程序等七個(gè)方面詳細(xì)論述了兩者之間的區(qū)別,并對(duì)兩者的相同之處進(jìn)行了簡要的介紹。隨后將我國的勞動(dòng)教養(yǎng)與外國的保安處分制度進(jìn)行比較,在此基礎(chǔ)上討論了“保安處分制度是否適用于中國”的問題,本人認(rèn)為中國目前尚不具備適用保安處分制度的條件,并從理論基礎(chǔ)、思想根源及司法環(huán)境三個(gè)方面闡述了該制度暫不能移植到中國的原因。 第三部分是勞動(dòng)教養(yǎng)的弊端及缺陷分析。這一部分著重論述了我國現(xiàn)今勞動(dòng)教養(yǎng)制度的種種弊端和缺陷,并從實(shí)體法和程序法兩方面進(jìn)行了詳細(xì)的闡述,進(jìn)而指出對(duì)勞動(dòng)教養(yǎng)制度進(jìn)行改革已是勢(shì)在必行,為第四部分埋下了伏筆。 第四部分是勞動(dòng)教養(yǎng)制度的改革與完善。這一部分對(duì)勞動(dòng)教養(yǎng)制度的存廢問題以及勞動(dòng)教養(yǎng)制度的具體改革方案兩個(gè)方面進(jìn)行了論述,首先指出勞動(dòng)教養(yǎng)制度在當(dāng)今中國仍然具有存在的必要性,并不支持立即廢除該項(xiàng)制度。隨后,在對(duì)當(dāng)今法學(xué)界幾種具有代表性的勞動(dòng)教養(yǎng)改革方案進(jìn)行深刻剖析的基礎(chǔ)上,結(jié)合其中比較合理的內(nèi)容提出了自己的觀點(diǎn),并從勞動(dòng)教養(yǎng)的法律性質(zhì)、適用對(duì)象、執(zhí)行期限、適用程序、執(zhí)行模式五個(gè)方面詳細(xì)闡述了改革的具體措施,該部分也是本文的核心與重點(diǎn)。
[Abstract]:Reeducation through labour is a compulsory educational reform measure for offenders and minor offenders, and it is also one of the important legal means to crack down on illegal crimes in our country.It is a legal system with distinct Chinese characteristics formed in the construction of socialist legal system.Undoubtedly, from the very beginning of the establishment of the re-education through labour system, it made an important contribution to the security environment and social stability in our country at that time, and after more than 50 years of continuous development,The system of reeducation through labor has become an integral part of the socialist legal system of our country.However, up to now, the system has gradually shown that it is not suitable for the construction of the legal system today, and all kinds of shortcomings and defects have been exposed, which have seriously affected the process of rule of law in our country.If we let the present system of reeducation through labor go unchecked, it will affect the realization of the great strategy of governing the country according to law.The structure of this paper is divided into four parts, a total of more than 30,000 words.The first part is the historical evolution and present situation of reeducation through labor system.This part mainly introduces two problems, first of all, the historical evolution of the re-education through labor system, mainly expounds the historical background and development process of the birth of the re-education through labor system.Then it reveals the special social and political environment at the beginning of the establishment of the system and its distinctive significance of the times.The second is the current situation of the re-education through labor system, mainly from the legislative status of re-education through labour, applicable conditions, applicable procedures and the duration of implementation of the current situation of the re-education through labour system.So that readers have a clear understanding of the current system of re-education through labor in China, and pave the way for the second part, "comparison between reeducation through labor and related systems", and the third part, "Analysis of defects and drawbacks of re-education through labor".The second part is the comparison between reeducation through labor and related systems.This part first discusses the similarities and differences between re-education through labor and re-education through labor, focusing on the nature, purpose, applicable object, applicable procedures and other seven aspects of the differences between the two, and the similarities between the two are briefly introduced.Then, by comparing the system of reeducation through labour in China with that of foreign countries, this paper discusses the question of whether the system of security measures is applicable to China. I think that China does not have the conditions to apply the system of security measures at present.The reasons why the system can not be transplanted to China are expounded from three aspects: theoretical basis, ideological origin and judicial environment.The third part is the malpractice and defect analysis of reeducation through labor.This part focuses on the shortcomings and defects of the present system of re-education through labor in China, and expounds in detail from the aspects of substantive law and procedural law, and points out that it is imperative to reform the system of re-education through labor.Foreshadowing the fourth part.The fourth part is the reform and perfection of reeducation through labor system.This part discusses the existence and abolition of the system of re-education through labor and the specific reform scheme of the system of re-education through labor. Firstly, it points out that the system of re-education through labor still exists in China.There is no support for the immediate abolition of the system.Then, on the basis of the deep analysis of several representative reform schemes in the field of law education through labor, the author puts forward his own viewpoint on the basis of the more reasonable contents, and from the legal nature of reeducation through labor, the applicable object.The specific measures of the reform are elaborated in five aspects: duration of execution, applicable procedure and execution mode. This part is also the core and key point of this paper.
