【摘要】： 自人類文明發(fā)展進(jìn)入突飛猛進(jìn)的工業(yè)革命時(shí)代,伴隨著社會(huì)物質(zhì)條件的迅速豐富,包括青少年性犯罪在內(nèi)的各種犯罪發(fā)生率也是水漲船高。在這個(gè)階段中的一些犯罪預(yù)防手段,如刑罰、宗教、心理糾正、道德培育等,因過分專注于消滅犯罪,因此有司法預(yù)防的高成本、副作用,抑或社會(huì)預(yù)防的漫長效應(yīng)等缺憾。而發(fā)源于上世紀(jì)六十年代的情境預(yù)防理論,天生地具有強(qiáng)針對、高效率和低投入特征,展現(xiàn)了某些傳統(tǒng)犯罪預(yù)防理論所無法比擬的優(yōu)越性。面對青少年性犯罪嚴(yán)峻形勢,可以嘗試在犯罪情境預(yù)防理論角度突破傳統(tǒng)解決方案的弊端,并提出一些相關(guān)的預(yù)防基本設(shè)想。本文除引言和結(jié)語之外,分為四章: 第一章通過當(dāng)代中國青少年性犯罪的現(xiàn)狀描述,指出這種特殊犯罪現(xiàn)象在我國的發(fā)案率居高不下的嚴(yán)峻形勢,并剖析其主要特征。 第二章切入犯罪預(yù)防理論的發(fā)展歷史,簡要展開對情境預(yù)防理論沿革過程的探索和研究,并結(jié)合現(xiàn)實(shí)展示情境犯罪預(yù)防理論的實(shí)踐成果。 第三章根據(jù)情境預(yù)防理論的一些內(nèi)在優(yōu)秀理論品質(zhì),分析傳統(tǒng)犯罪預(yù)防手段的優(yōu)劣,著重展開情境預(yù)防理論應(yīng)用于青少年性犯罪預(yù)防而產(chǎn)生的種種預(yù)期的主流價(jià)值分析,包括經(jīng)濟(jì)價(jià)值和社會(huì)價(jià)值等。 第四章專門從情境預(yù)防角度出發(fā),討論青少年性犯罪控制和預(yù)防,在前文理論基礎(chǔ)上形成一些有實(shí)踐價(jià)值的具體情境預(yù)防措施,以期能遏制現(xiàn)階段青少年性犯罪的高發(fā)勢頭。 本文主要價(jià)值在于:面對青少年性犯罪這一課題,借由引入情境預(yù)防這一新型犯罪預(yù)防理論來轉(zhuǎn)向更多從具體情境層次考慮的理論支持點(diǎn),試圖突破舊式低效的解決方案,充分論證情境預(yù)防理論針對該類犯罪所體現(xiàn)出來的創(chuàng)新因素,并提出一些相關(guān)的預(yù)防基本設(shè)想。通過本文的論述和設(shè)想來促進(jìn)對青少年性犯罪長效預(yù)防制度的完善是對國家、民族希望的負(fù)責(zé),也是文章的根本目的。
[Abstract]:With the rapid development of human civilization and the rapid development of the industrial revolution, with the rapid enrichment of social material conditions, the incidence of various crimes, including juvenile sex crimes, is also rising.In this stage, some means of crime prevention, such as punishment, religion, psychological correction, moral cultivation and so on, have some shortcomings such as high cost, side effect of judicial prevention, or long effect of social prevention, because they focus too much on the elimination of crime.The theory of situational prevention, which originated in the sixties of last century, has the characteristics of strong, high efficiency and low input, which shows the superiority of some traditional theories of crime prevention.In the face of the serious situation of juvenile sex crime, we can try to break through the drawbacks of traditional solutions in the theory of crime situation prevention, and put forward some basic prevention ideas.In addition to the introduction and conclusion, this article is divided into four chapters:The first chapter describes the current situation of juvenile sex crime in contemporary China, points out the severe situation of the high incidence rate of this special crime phenomenon in China, and analyzes its main characteristics.The second chapter focuses on the history of crime prevention theory, and briefly explores and studies the evolution of situational crime prevention theory, and displays the practical results of situational crime prevention theory combined with reality.The third chapter analyzes the advantages and disadvantages of the traditional crime prevention methods according to the internal excellent theoretical qualities of the situational prevention theory, and focuses on the analysis of the mainstream value of the application of the situational prevention theory to the juvenile sexual crime prevention.Including economic value and social value.The fourth chapter discusses the control and prevention of juvenile sexual crime from the perspective of situational prevention. Based on the previous theory, it forms some concrete situational prevention measures with practical value, in order to curb the high incidence of juvenile sexual crime at the present stage.The main value of this paper lies in: in the face of the subject of juvenile sexual crime, by introducing situational prevention, a new crime prevention theory, to turn to more theoretical support points considered from the specific situation level, trying to break through the old low-efficiency solution.This paper fully demonstrates the innovative factors embodied in situational prevention theory in view of this kind of crime, and puts forward some basic ideas of prevention.It is the responsibility of the nation and the nation to promote the perfection of the long-term prevention system of the juvenile sexual crime through the discussion and assumption of this paper, which is also the basic purpose of the article.
