【摘要】：隨著人類司法文明的不斷推進(jìn),非監(jiān)禁刑罰也逐步進(jìn)入人類的視野,社區(qū)矯正作為與監(jiān)禁矯正相對(duì)應(yīng)的一種特殊行刑方式,是在世界各國刑罰人道化、刑罰輕緩化與刑罰社會(huì)化的發(fā)展進(jìn)程中興起的。為了適應(yīng)國際社會(huì)關(guān)于行刑人道化與社會(huì)化的發(fā)展趨勢(shì),我國于21世紀(jì)初也在全國多個(gè)省市開始了社區(qū)矯正試點(diǎn)工作。經(jīng)過十多年的努力,我國社區(qū)矯正工作取得了較大的成就,社區(qū)矯正在司法實(shí)踐過程中也發(fā)揮了積極的作用。但值得注意的是,現(xiàn)階段我國社區(qū)矯正較國外發(fā)達(dá)國家而言,總體發(fā)展水平仍然較為低下,其在發(fā)展過程中也面臨著巨大的困境。本文以溫州市甌海區(qū)社區(qū)矯正工作實(shí)踐為切入點(diǎn),在掌握了有關(guān)社區(qū)矯正的基本理論的基礎(chǔ)上,綜合運(yùn)用了文獻(xiàn)分析、訪談法以及案例分析等研究方法,對(duì)溫州市甌海區(qū)社區(qū)矯正工作展開了實(shí)證分析與研究。通過深入調(diào)查溫州市甌海區(qū)社區(qū)矯正工作的開展情況,對(duì)甌海區(qū)在社區(qū)矯正工作實(shí)踐中面臨的諸如機(jī)構(gòu)設(shè)置、隊(duì)伍建設(shè)、社會(huì)公眾參與、職能部門配合與銜接等多方面問題的系統(tǒng)分析,尋找有效提升甌海區(qū)社區(qū)矯正工作的核心因素與著力點(diǎn),并總結(jié)和汲取上海地區(qū)優(yōu)秀的社區(qū)矯正經(jīng)驗(yàn),思考有效解決我國社區(qū)矯正問題的方法,進(jìn)而不斷地完善我國社區(qū)矯正制度,具有較強(qiáng)的理論與現(xiàn)實(shí)意義。
[Abstract]:With the continuous advancement of human judicial civilization, non-custodial punishment has gradually entered the human field of vision. Community correction, as a special execution method corresponding to imprisonment correction, is humanization of punishment in various countries of the world. In order to adapt to the development trend of humanization and socialization of execution in the international community, In 21th century, our country also started the pilot work of community correction in many provinces and cities throughout the country. After more than a decade of efforts, our country's community correction work has made great achievements. Community correction has also played an active role in the judicial practice. However, it is worth noting that the overall level of development of community correction in China is still relatively low compared with that of developed countries abroad. This paper takes the practice of community correction in Ouhai District of Wenzhou City as the breakthrough point, on the basis of mastering the basic theory of community correction, and makes comprehensive use of literature analysis. With the methods of interview and case analysis, this paper makes an empirical analysis and research on the community correction work in Ouhai District of Wenzhou City. Through the investigation of the community correction work in Ouhai District of Wenzhou City, the author makes a thorough investigation on the development of community correction work in Ouhai District, The systematic analysis of the problems faced in the practice of community correction in Ouhai area, such as organization setting, team building, social and public participation, coordination and convergence of functional departments, etc. To find out the core factors and focus of community correction in Ouhai area, and to summarize and draw on the excellent experience of community correction in Shanghai, and to think about how to solve the problem of community correction effectively in our country. Therefore, it is of great theoretical and practical significance to improve the system of community correction in our country.
