【摘要】： 行政處罰自由裁量權(quán)是現(xiàn)代行政必不可少的組成部分,它的行使是依法行政的難點(diǎn),依法加強(qiáng)對(duì)行政處罰自由裁量權(quán)的控制對(duì)于加強(qiáng)依法行政、實(shí)現(xiàn)依法治國(guó)目標(biāo)具有重大意義。出入境邊防檢查機(jī)關(guān)是具體行使行政處罰自由裁量權(quán)的口岸行政執(zhí)法機(jī)構(gòu)。本文闡述了邊防檢查行政處罰自由裁量權(quán)的概況、存在的理論基礎(chǔ)、現(xiàn)實(shí)問題及控制辦法。邊防檢查行政自由裁量權(quán)行使時(shí)主要存在執(zhí)法考慮不周、適用法律不當(dāng)及違背合理性原則等問題,這些問題根源于行政執(zhí)法依據(jù)不完善和執(zhí)法者素質(zhì)偏低,文章從完善立法、強(qiáng)化監(jiān)督和提高人員素質(zhì)三個(gè)方面提出了解決上述問題的途徑。
[Abstract]:The discretion of administrative punishment is an indispensable part of modern administration, and its exercise is the difficulty of administration according to law. To strengthen the control of the discretion of administrative punishment according to law is to strengthen the administration according to law. It is of great significance to achieve the goal of governing the country according to law. The entry and exit frontier inspection organ is a port administrative law enforcement agency that exercises the discretion of administrative punishment. This paper expounds the general situation of the administrative penalty discretion of frontier defense inspection. The existing theoretical basis, practical problems and control measures. The main problems in the exercise of administrative discretion in frontier inspection are inadequate consideration of law enforcement, improper application of the law and violation of the principle of rationality, etc. These problems are rooted in the imperfection of the administrative law enforcement basis and the low quality of the law-enforcers. This paper puts forward some ways to solve the above problems from three aspects: perfecting the legislation, strengthening the supervision and improving the quality of the personnel.
