【摘要】： 警察腐敗問題是各國刑事司法學(xué)界關(guān)注的焦點(diǎn)問題,科學(xué)的界定警察腐敗的內(nèi)涵是研究這一問題的關(guān)鍵。國內(nèi)外學(xué)者從各自國家的警察體制出發(fā)提出了獨(dú)到見解,可以說是各有千秋。國外學(xué)者的觀點(diǎn)可概括為四種“學(xué)說”,即：警察以權(quán)謀私說、警察貪污受賄說、警察職業(yè)越軌行為說、警察非法行為說。國內(nèi)學(xué)者對警察腐敗內(nèi)涵的界定分廣義的界定和狹義的界定兩種,二者的區(qū)別主要體現(xiàn)在兩點(diǎn)：一點(diǎn)是對警察腐敗的行為方式的認(rèn)識(shí)不同,一點(diǎn)是對警察腐敗范圍的界定不同。綜觀國內(nèi)外觀點(diǎn),筆者從腐敗行為的主體、腐敗行為的方式、腐敗行為的目的、腐敗行為的后果四要素出發(fā),對警察腐敗的內(nèi)涵界定如下：警察腐敗即人民警察濫用職權(quán),謀取私利,嚴(yán)重?fù)p害國家和人民利益的行為。其具有腐敗主體的特定性、腐敗形式的多樣性及社會(huì)危害的嚴(yán)重性三大特征。 任何社會(huì)現(xiàn)象的產(chǎn)生、發(fā)展都有其深刻的社會(huì)政治、經(jīng)濟(jì)、文化、思想、歷史等方面的原因,警察腐敗現(xiàn)象也不例外,就我國目前警察腐敗嚴(yán)重化的態(tài)勢而言,除了一般性原因外,更有其特定的時(shí)代性和中國特色。市場經(jīng)濟(jì)原則和規(guī)范的泛化是警察腐敗的經(jīng)濟(jì)原因,警察管理體制的缺陷是警察腐敗的制度原因,警察工作的特殊性是其腐敗的職業(yè)原因,一些警察職業(yè)道德的缺失和道德人格的分裂是警察腐敗的道德原因,警察不健康心理的存在是警察腐敗的心理原因。 遏制警察腐敗是一個(gè)嚴(yán)峻而艱巨的任務(wù),長期以來我們僅重視制度、法律制腐,而忽視了道德制腐的巨大作用。實(shí)際上,道德制約對于警察腐敗有著獨(dú)到的作用機(jī)制：道德制約對于警察腐敗具有能動(dòng)作用；道德制約可以彌補(bǔ)法律、制度制約之局限；道德自律是反腐倡廉的最高境界。由此可見,道德制約對于遏制警察腐敗功不可沒。構(gòu)建警察腐敗的道德制約機(jī)制必須從以下七方面入手：完善警察職業(yè)道德規(guī)范體系；健全警察道德監(jiān)控機(jī)制；完善警察道德評價(jià)機(jī)制；落實(shí)警察道德保障機(jī)制；加強(qiáng)警察的職業(yè)道德教育；培養(yǎng)警察的職業(yè)角色意識(shí)；養(yǎng)成警察的職業(yè)和生活操守。
[Abstract]:The problem of police corruption is the focus of the criminal justice circles in various countries, and the scientific definition of the connotation of the police corruption is the key to study this problem. The scholars at home and abroad have put forward their own unique views from the police system of their respective countries. The views of foreign scholars can be summed up as four kinds of "doctrines", namely, the theory of police using power for personal gain, the theory of police embezzlement and bribery, and the theory of police professional deviant behavior. The definition of police corruption by domestic scholars can be divided into two types: broad definition and narrow definition. The difference between the two is mainly reflected in two points: one is the different understanding of the behavior of police corruption. One point is the different definition of the scope of police corruption. Looking at the domestic and foreign viewpoints, the author starts from the main body of the corrupt behavior, the way of the corrupt behavior, the purpose of the corrupt behavior, the consequence of the corrupt behavior. The connotation of police corruption is defined as follows: police corruption is the behavior of the people's police abusing their power, seeking personal gain and seriously harming the interests of the state and the people. The diversity of corruption forms and the seriousness of social harm are three characteristics. The emergence and development of any social phenomenon has its profound social, political, economic, cultural, ideological, historical and other reasons, and the phenomenon of police corruption is no exception. As far as the situation of serious police corruption is concerned, In addition to the general reasons, it has its specific epoch and Chinese characteristics. The generalization of the principles and norms of the market economy is the economic cause of the police corruption, and the defects of the police management system are the institutional reasons of the police corruption. The particularity of police work is the professional reason of corruption, the lack of some police professional ethics and the split of moral personality are the moral reasons of police corruption, and the existence of police unhealthy psychology is the psychological reason of police corruption. It is a severe and arduous task to curb police corruption. For a long time, we have only attached importance to the system and the law, but neglected the enormous role of moral corruption. In fact, The moral restriction has the unique function mechanism to the police corruption: the moral restriction has the dynamic function to the police corruption; the moral restriction can make up for the limitation of the law and the system restriction; the moral self-discipline is the highest realm of the anti-corruption. Moral restriction can not be ignored in curbing the police corruption. The construction of the moral restriction mechanism of police corruption must start from the following seven aspects: perfecting the police professional ethics standard system, perfecting the police moral monitoring mechanism, perfecting the police moral evaluation mechanism, and improving the police moral evaluation mechanism. To carry out the police moral guarantee mechanism, to strengthen the professional ethics education of the police, to cultivate the professional role consciousness of the police, and to develop the professional and life ethics of the police.
