【摘要】：正2015年2月27日,最高人民檢察院發(fā)布了《關(guān)于強制隔離戒毒所工作人員能否成為虐待被監(jiān)管人罪主體問題的批復(fù)》(以下簡稱《批復(fù)》)。為便于司法實踐中正確理解和適用《批復(fù)》的相關(guān)規(guī)定,現(xiàn)對《批復(fù)》的制定背景及經(jīng)過、主要內(nèi)容介紹如下:一、《批復(fù)》的制定背景及過程2014年,河北省檢察機關(guān)在辦理一起強制隔離戒毒所干警涉嫌虐待戒毒人員案件時,對強制隔離戒毒所監(jiān)管人員能否成為刑法第二百四十八條虐待被監(jiān)管人罪主體問題存在不同認識。河北省人民檢察院
[Abstract]:On February 27th 2015, The Supreme people's Procuratorate has issued a "written reply on whether or not the staff of a compulsory quarantine detoxification center can become the subject of the crime of mistreating a person under supervision." (hereinafter referred to as the "approval"). In order to facilitate the correct understanding and application of the relevant provisions of the "written reply" in judicial practice, The main contents are as follows: 1.
