【摘要】：改革開放以來,國家經(jīng)濟和社會發(fā)展日新月異,人民生活水平穩(wěn)步提高,但是,關(guān)于刑釋人員出獄后重新犯罪的問題卻愈發(fā)嚴重,已經(jīng)嚴重危害到國民經(jīng)濟發(fā)展和社會安定團結(jié)。刑釋人員的重新犯罪問題若得不到足夠的重視和預(yù)防,勢必會影響到我國的改革開放成果與和諧社會發(fā)展進程。因此,刑釋人員的重新犯罪問題是當(dāng)前社會亟待解決的一個重要問題。從安徽省監(jiān)獄系統(tǒng)近年對重新犯罪的調(diào)查情況看,刑滿釋放人員重新犯罪具有“呈波次性上升、以財產(chǎn)為主要犯罪目標(biāo)、刑釋三年內(nèi)是重新犯罪高峰、流動性大、以青壯年為主、文化程度低、刑期短、沒有固定職業(yè)、暴力性強”等特點。本文通過界定重新犯罪問題的相關(guān)概念,從刑釋人員重新犯罪的原因分析入手,將我國刑滿釋放人員最近幾十年有關(guān)重新犯罪的情況進行縱向比較,來闡述重新犯罪及其預(yù)防問題,以期引起全社會的關(guān)注和重視。 文章認為,關(guān)于刑釋人員重新犯罪問題不僅有其個人的主觀原因,也有較為復(fù)雜的社會原因,還有法律制度和改造質(zhì)量等方面的原因。預(yù)防重新犯罪,必須綜合考慮,標(biāo)本兼治,才能真正起到防治的效果。本文就刑釋人員重新犯罪的預(yù)防進行了探討和分析,認為需要進一步加快法治進程,吸收國外先進經(jīng)驗,完善監(jiān)獄現(xiàn)有的教育、改造管理體制,貫徹、實踐行刑社會化理念,保障刑釋人員的各項合法權(quán)利,逐步建立起有中國特色的預(yù)防刑釋人員重新犯罪的制度體系。具體包括：一要進一步提高教育改造水平,不斷提升刑釋人員個體綜合素質(zhì)。加強刑釋人員獄內(nèi)政治文化技術(shù)教育,創(chuàng)新監(jiān)獄文化建設(shè),提高其法律道德水平和生活技能,增強其回歸社會的適應(yīng)能力。二要進一步創(chuàng)新監(jiān)獄管理模式,不斷提高改造質(zhì)量,為刑釋人員再社會化奠定良好的基礎(chǔ)。進一步推進監(jiān)獄分類管理,不斷提升監(jiān)獄改造功能；開展服刑人員改造質(zhì)量評估,增強矯治的針對性,與社會幫教實現(xiàn)無縫對接；試用勞動改造工資制度,增強服刑人員人格社會化；積極開展服刑人員心理矯治工作,提高心理健康水平；通過親情教育,幫助服刑人員建立起回歸社會的信心；積極預(yù)簽用工合同,使服刑人員成為“準(zhǔn)社會人”,為順利融入社會打下基礎(chǔ)。三要進一步完善社區(qū)矯正工作體制和出獄人保護制度,不斷提高社會和諧水平。要深化司法體制改革,推進社區(qū)矯正立法；要進一步加強對社區(qū)矯正工作兩重性的認識,更新工作理念；要堅持以人為本,進一步改進完善社區(qū)矯正工作機制。要健全出獄人社會保護制度,對刑釋人員的管理、保護進行單獨立法,建立以社區(qū)為基礎(chǔ)的警民合作型刑釋人員管護制度,完善相關(guān)法律、法規(guī),將刑釋人員的管護工作向“釋前”延伸。四要健全刑事法律威懾政策,不斷提高法律制度的防范能力。要完善累犯制度,刑罰執(zhí)行要重視懲罰的個別化,要修改完善《監(jiān)獄法》,使之更加符合監(jiān)管改造工作需要。
[Abstract]:Since the reform and opening up, the national economic and social development change rapidly, people's living standards improved steadily, but about the released prisoners after prison to crime problem has become more serious, has serious harm to the development of national economy and social stability and unity. The crime problem of released prisoners if not enough attention and prevent, it will affect China's achievements of reform and opening-up and the development of harmonious society process. Therefore, the new crime of ex convict personnel is an important problem to be solved in current society. From the prison system in Anhui Province in recent years to re crime investigation, the re released crime has a "wave of rise of property is the main target of crime through three years, returning to crime peak, mobility, mainly young people, low education level, short term, no fixed occupation characteristics, strong violence." this This paper through defining the relevant concepts to the crime problem, starting from the analysis of the reason recommit a crime, will be released in China in recent years the situation related to crime of longitudinal comparison, elaborated to crime and prevention problems, in order to arouse the attention from whole society.
The article thinks, about recommit a crime problem is not only the individual's subjective reason, also have more complex social reasons, reasons and legal system and transform quality. Prevent the crime, we must consider, tackling the problem, in order to prevent and control effect. This paper discussed and analyzed the prevention we recommit a crime, it is necessary to further accelerate the process of the rule of law, absorbing foreign advanced experience, improve the existing prison education, implement the transformation of management system, practice socialization concept, safeguard the legitimate rights of prisoners, and gradually establish a system with Chinese characteristics to prevent recommit a crime. Including: one is to further improve the education reform, and constantly improve the individual comprehensive quality. To strengthen the emancipists prison political culture technology education, the innovation of the prison The construction, improve the legal level of morality and life skills, enhance their ability to adapt to return the society. Two to further innovate the prison management mode, and constantly improve the quality of the transformation for emancipists re socialization to lay a good foundation. To further promote the prison classification management, and constantly improve the prison function; carry out prisoners quality assessment, enhanced for treatment, and social services to achieve seamless trial; labor salary system reform, strengthen the prisoners personality socialization; actively carry out inmates psychological treatment, improve the level of mental health; through family education, to help the prisoners to return to society to establish confidence; actively advance sign labor contract, make prisoners become "quasi the social person", lay the foundation for smoothly into society. Three to further improve the system of community correction and social protection system, not To continuously improve the level of social harmony. We should deepen the reform of the judicial system, promote community correction legislation; to further strengthen the understanding of community correction duality, update the work ethic; to adhere to the people-oriented, improve and perfect the community correction mechanism. To improve the exconvict social protection system, the ex convict personnel management, protection of separate legislation, the establishment of community-based police cooperation type emancipists management system, improve relevant laws and regulations, will extend the emancipists and protection work to "pre release". The four is to perfect the criminal law deterrent policy, and constantly improve the legal system.
