摘要：

我國(guó)《涉外民事關(guān)系法律適用法》充分考慮了對(duì)人權(quán)的保護(hù)，，在保護(hù)弱勢(shì)群體、法律選擇的意思自治、人格權(quán)的保護(hù)及在婚姻和繼承領(lǐng)域規(guī)定選擇性沖突規(guī)范等方面都體現(xiàn)了保護(hù)人權(quán)的價(jià)值取向，但也存在一些不足，有些涉及人權(quán)保護(hù)的法律適用規(guī)則沒有作出相應(yīng)的規(guī)定，有些規(guī)定則不能充分保障涉外民事關(guān)系當(dāng)事人的人權(quán)。我國(guó)《涉外民事關(guān)系法律適用法》要通過直接適用的法、公共秩序保留等制度進(jìn)一步健全、完善對(duì)人權(quán)的保護(hù)。

Abstract： 

The Application Law of Foreign Civil Relationship of our country gives a full consideration to human rights protection, this can be seen in protection of weak groups, of personality right, etc. Yet itl has shortcomings. Some articles of the law do not provide the relevant rules while some rules do not fully protect （the） human rights of the clients. The application law of foreign civil relationship of our country should be further improved in human rights protection through immediate application law and public order system.
