【摘要】：英國1215年的《自由大憲章》自晚清傳入中國以來,對晚清中國的人權(quán)思想、立黨政治以及憲法學(xué)說產(chǎn)生了重要的影響。這一過程,也是《大憲章》"華化"的肇始�！洞髴椪隆吩谕砬逯袊霈F(xiàn)了多個版本的中文譯本,其精神和內(nèi)容獲得了晚清士人的全面評介,從而促進(jìn)了其在晚清中國的傳播。同時,《大憲章》引發(fā)了晚清士人的深刻反思,他們思考的主要問題包括:《大憲章》與憲法的關(guān)系,應(yīng)當(dāng)照搬還是借鑒《大憲章》,以及晚清社會應(yīng)當(dāng)走改革之路還是行革命之道。
[Abstract]:Since the introduction of the Magna Carta of Freedom in 1215 to China in the late Qing Dynasty, it has had an important influence on the thought of human rights, party politics and constitutional theory in China in the late Qing Dynasty. This process is also the beginning of the Magna Carta "Sinicization". The Magna Carta appeared in China in the late Qing Dynasty, and its spirit and content were comprehensively reviewed by the scholars in the late Qing Dynasty, thus promoting its dissemination in China in the late Qing Dynasty. At the same time, the Magna Carta triggered a profound reflection on the scholars in the late Qing Dynasty. The main issues they thought about included: the relationship between the Magna Carta and the Constitution, whether to copy or draw lessons from the Magna Carta, and whether the society in the late Qing Dynasty should take the road of reform or carry out the way of revolution.
