法治唯理主義建構(gòu)及其批判

【摘要】:唯理主義是傳統(tǒng)理性主義極端化的變體,古希臘羅馬時代就有唯理主義的傳統(tǒng),而近代,隨著科學技術(shù)的發(fā)展,社會的進步和變革的加劇,需要迅速產(chǎn)生規(guī)則來適應(yīng)和維持社會的秩序,這為唯理主義法治建構(gòu)理論提供了適合的時代背景,F(xiàn)代法治國家建構(gòu)本身作為一個理性的活動必定需要理性的參與,理性對于制度的構(gòu)建確實發(fā)揮著重大的作用。但重大并非唯一,理性并非萬能。如果迷信理性,認為理性能夠掌控、計劃人類社會的一切事務(wù),必將陷入唯理主義的泥淖,以為法律就是“以立法統(tǒng)合整個法律”,加上具有組織化政府的偏向推進,社會秩序?qū)⒊尸F(xiàn)出一元的法治秩序,而去除了習慣、風俗等社會內(nèi)部產(chǎn)生的秩序形式,這與真實的秩序形態(tài)不符。這也將帶來侵蝕自由,過度精英化,脫離真實生活的惡果。尊重理性,尊重人類生活就需要現(xiàn)代法治國家謹防唯理主義“元意識形態(tài)”支配下的法治建構(gòu),防范夸大知識和理性的作用,防范唯理主義的法治秩序觀,這對當下中國的法治建構(gòu)尤具意義。
[Abstract]:Rationalism is a variant of the extremes of traditional rationalism. In ancient Greece and Rome, there was the tradition of rationalism. In modern times, with the development of science and technology and the aggravation of social progress and change, it is necessary to produce rules quickly to adapt to and maintain the social order, which provides a suitable background for the construction theory of rationalism under the rule of law. The construction of modern country ruled by law itself as a rational activity must need rational participation, rationality does play an important role in the construction of the system. But great is not the only, reason is not omnipotent. If we believe that reason can control and plan all the affairs of human society, we will certainly fall into the quagmire of rationalism, thinking that the law is "integrating the whole law with legislation". In addition, with the bias of an organized government, the social order will present a unitary order of the rule of law, and the form of order produced within the society, such as habits and customs, will be removed. This is inconsistent with the real form of order. This will also lead to the erosion of freedom, excessive elitism, away from the consequences of real life. Respecting reason and human life requires modern countries ruled by law to guard against the construction of the rule of law under the domination of rationalism "meta-ideology", to prevent exaggerating the role of knowledge and reason, and to prevent the view of order of rule of law of rationalism, which is of particular significance to the construction of the rule of law in China at present.
