【摘要】：正【裁判要旨】實習(xí)生在實習(xí)單位工作中因其自身一般性過錯致受傷的,不能減輕實習(xí)單位的賠償責(zé)任,實習(xí)生不因其一般性過錯而自擔(dān)部分責(zé)任;學(xué)校就實習(xí)生在實習(xí)中的安全防范和權(quán)益保障,對實習(xí)單位未盡到應(yīng)有的督促義務(wù)的,應(yīng)根據(jù)其過錯程度對實習(xí)生的受傷承擔(dān)相應(yīng)責(zé)任;在城市中小學(xué)校就讀的外地農(nóng)村戶籍學(xué)生,在學(xué)校的教育教學(xué)活動(含派出實習(xí))中受傷致殘的,其殘疾賠償金可以按照學(xué)校所在地城鎮(zhèn)居民標(biāo)準(zhǔn)計算。

The compensation for disability can be calculated according to the standard of urban residents in the place where the school is located.
