馬克思主義法律思想的中國起源探析

【摘要】:馬克思主義法律思想中國化是馬克思主義法律思想在中國傳播成功的前提下,伴隨著馬克思主義法律思想與中國的實踐相結合的歷史進程而開拓、創(chuàng)新和不斷前進的。既然是一個歷史過程,,就一定有一個起點,這便是“馬克思主義法律思想的中國起源”問題。本文的研究目的正是基于對馬克思主義法律思想在中國的傳播與馬克思主義法律思想中國化的關系的認識,因此,其最終旨趣落在馬克思主義法律思想中國化上,審視“馬克思主義法律思想的中國起源”在馬克思主義法律思想中國化歷史進程上的意義,并總結該起源所蘊含的意義與局限性,從而為馬克思主義法律思想中國化繼續(xù)推進提供現(xiàn)代啟示。 本文分為五個部分: 引論部分介紹了本文的問題來源與研究意義、以“五四”時期作為研究對象的原因、以及與本文相關研究的研究現(xiàn)狀,并著重指出本文的“外史”與“內史”的研究方法。 第一部分,“五四”后期(1919—1921),馬克思主義法律思想的中國起源,以“五四”時期李大釗和胡漢民的文章為研究文本,挖掘了馬克思主義法律思想中國起源之時,中國早期的馬克思主義傳播者著重闡釋了經濟基礎決定上層建筑這一歷史唯物主義法律思想的理論基礎、法的階級意志觀、法的歷史發(fā)展理論、法與經濟的關系以及人的自由發(fā)展觀等馬克思主義法律思想內容。 第二部分,一種外史的視角——“五四”前期(1915—1918)的社會與思想,是運用外史的研究方法,分析“馬克思主義法律思想的中國起源”與當時的社會歷史條件以及時代氛圍的關系,從思想家出現(xiàn)和發(fā)展的政治經濟文化條件揭示出“馬克思主義法律思想中國起源”的原因在于唯物史觀與革命的關聯(lián)性。 第三部分,一種內史的視角——三大論爭的意義,是通過還原當時馬克思主義傳播者在同各種非馬克思主義甚至反馬克思主義思想的論爭中所呈現(xiàn)出來的特征,揭示他們接受馬克思主義法律思想的原因也在于試圖通過革命手段解決當時中國的問題。 本文的結論:其一,“五四”時期可以視為“馬克思主義法律思想的中國起源”,而并非“馬克思主義法律思想中國化的開端”,馬克思主義法律思想中國化必須具備實踐品格;其二,馬克思主義法律思想中國化必須完成從“革命”邁向“建設”的轉化,適應新時代的要求,立足當下中國法治實踐,不斷創(chuàng)新和超越,為法治建設提供新的智慧與貢獻。
[Abstract]:The sinicization of the Marxist legal thought is the premise that the Marxist legal thought is successful in China, and is developed, innovated and advanced along with the historical process of the combination of the Marxist legal thought and the practice of China. Since it is a historical process, there must be a starting point, which is a question of "The Chinese Origin of the Marxist Legal Thought". The purpose of this paper is based on the understanding of the relationship between the dissemination of the Marxist legal thought in China and the sinicization of the Chinese legal thought, so its final interest is on the sinicization of the Marxist legal thought, This paper examines the significance of the "The Chinese Origin of the Marxist Legal Thought" in the process of the sinicization of the Chinese legal thought, and summarizes the meaning and limitation of the origin, so as to provide the modern enlightenment for the sinicization of the Chinese legal thought. This paper is divided into five parts In this paper, the paper introduces the origin and significance of the paper, the reason of the May 4th period as the research object, and the research status of the research in this paper, and highlights the research of the external history and the internal history. The relationship between the atmosphere of the times and the political and economic cultural conditions of the emergence and development of the thinkers reveal the reason of the "The Origin of China's Legal Thought in China" lies in the historical materialism The relevance of the revolution, the third part, the view of an internal history, the significance of the three debates, is through the reduction of the time that the Marxist propagator is in the debate with various non-Marxist and even anti-Marxist ideas The features presented and the reason for revealing their acceptance of the Marxist legal thought are also in an attempt to pass the revolutionary means To solve the problem in China at that time, the conclusion of this paper: First, the "May 4th Movement" period can be regarded as a "The Chinese Origin of the Marxist Legal Thought", not a "The Beginning of the Sinicization of the Marxist Legal Thought", and the sinicization of the Marxist legal thought must have the practical character; and secondly, the sinicization of the Marxist legal thought must be completed from the "the revolution" to the "trunk>" construction.
