【摘要】：吳經(jīng)熊的自然法理論是在對(duì)施塔姆勒及霍姆斯分析批判的基礎(chǔ)上,又吸取了托馬斯及中國(guó)儒家孟子的相關(guān)思想建立而來(lái),具有濃厚的天主教色彩,尤其推重中國(guó)傳統(tǒng)的直覺(jué)方式。他以中國(guó)傳統(tǒng)文化與西方文化相結(jié)合的方式來(lái)重新解讀自然法的嘗試,是他的自然法思想與歐洲其他法理學(xué)家的最大不同之處,為融合并超越東西方文化做出了新的嘗試。
[Abstract]:Wu Jingxiong's theory of natural law is based on the analysis and criticism of Starmler and Holmes, and absorbs the relevant ideas of Thomas and Chinese Confucianism Mencius, which has a strong Catholic color, especially the traditional Chinese intuitive way. His attempt to reinterpret natural law in the way of the combination of Chinese traditional culture and western culture is the greatest difference between his thought of natural law and other European jurists, and makes a new attempt to merge and surpass the eastern and western cultures.
