“解百納”商標爭議案評析

【摘要】:被冠以“中國葡萄酒業(yè)知識產(chǎn)權(quán)第一案”的“解百納”商標權(quán)爭議案,歷時長達九年,影響巨大,引發(fā)了包括企業(yè)、行業(yè)協(xié)會、消費者和學界的廣泛關(guān)注。在該案爭議的背后,涉及到各個方面的利益博弈,要兼顧各方利益,平息糾紛,不僅對我國商標保護實踐工作提出了挑戰(zhàn),也對檢驗我國商標保護理論有重要意義。商標獲得注冊的前提條件是必須具備顯著性,能夠區(qū)分和指示商品或服務的來源。作為在一定范圍內(nèi)被公眾所知曉、普遍使用的通用名稱,一方面反映出一類商品的自然屬性,不具備顯著性特征;另一方面由于其通用性屬于公共資源,不允許獨占而由全行業(yè)共享,一般被法律禁止注冊。作為例外,通用名稱要獲得注冊,就必需具備原詞義之外的“第二含義”,并以此含義通過使用,能夠建立起消費者與特定商品的聯(lián)系。為了兼顧行業(yè)及大眾利益,在特定條件下,他人以通用名稱本身所具有的描述性特點使用該商標的文字,就有可能構(gòu)成對注冊商標的合理使用。另外,參與市場競爭過程中,不規(guī)范的商標使用行為,會弱化商標的顯著性特征,如果不及時采取有效措施,放任自流,注冊商標有可能淪為通用名稱,最終因喪失顯著性而失去商標權(quán)!敖獍偌{”商標爭議案折射出我國商標制度不完善的地方:《商標法》中沒有關(guān)于通用名稱認定標準以及商標合理使用判定內(nèi)容,其主體性地位缺失;其他相關(guān)規(guī)定過于原則化,實際可操作性差,難以有統(tǒng)一的認識和精確把握,這些問題的存在,使得該案在處理過程中更增加了復雜性。我國應當在研究和總結(jié)國內(nèi)外理論和實踐基礎(chǔ)上,探討上述標準的具體規(guī)則,最終形成立法,完善我國商標制度。
[Abstract]:The dispute over the trademark right of "the first case of intellectual property Rights in Chinese Wine Industry" lasted for nine years and had a great influence, which attracted extensive attention from enterprises, trade associations, consumers and academic circles. Behind the dispute in this case, there is a game of interests in all aspects. It is not only challenging the practice of trademark protection in our country, but also of great significance to test the theory of trademark protection in our country. The prerequisite for trademark registration is that it must be significant and able to distinguish and indicate the source of goods or services. As a common name widely used by the public in a certain range, on the one hand, it reflects the natural attributes of a class of commodities and does not have significant characteristics; on the other hand, because its universality belongs to public resources, it is not allowed to be monopolized and shared by the whole industry, which is generally prohibited by law. As an exception, in order to be registered, a general name must have a "second meaning" other than the original meaning, and by using this meaning, it can establish the relationship between consumers and specific goods. In order to take into account the interests of the industry and the public, under certain conditions, the use of the trademark by others with the descriptive characteristics of the common name itself may constitute a reasonable use of the registered trademark. In addition, in the process of participating in the market competition, the irregular trademark use behavior will weaken the significant characteristics of the trademark. If effective measures are not taken in time and laissez-faire, the registered trademark may become a common name and eventually lose the trademark right because of the loss of significance. The motion of "Jiebana" trademark dispute reflects the imperfection of trademark system in our country: there is no standard of identification of general name and the content of reasonable use of trademark in Trademark Law, and its subjective position is missing; other relevant provisions are too regular, the actual maneuverability is poor, and it is difficult to have a unified understanding and accurate grasp. The existence of these problems increases the complexity of the case in the process of dealing with it. On the basis of studying and summing up the theory and practice at home and abroad, our country should discuss the specific rules of the above standards, finally form legislation and perfect the trademark system of our country.
