【摘要】：在秦漢時期的審判制度中,每次庭審審判官多為三人或三人以上,也有兩人的情況,但沒有一人獨自審判的情況,其中史參與案件的判決是秦及漢初的通行做法。"史"在其中扮演著一種不可或缺的角色。獄史不但參與審判,抓差辦案等事宜也多由獄史承擔。在法庭決獄時,必須有史的參與,否則有關(guān)判決將會受到質(zhì)疑,主管官吏甚至?xí)蛔肪控熑�。令史中有負責刑獄事務(wù)的,實際上在這種情況下其應(yīng)屬于獄史;獄史分為不同的級別,其中就包括令史在內(nèi),也就是說并不是所有的獄史都是令史。史在審案過程中也分等級,且并非不受限制。
[Abstract]:In the trial system of Qin and Han dynasties, most of the judges in each trial were three or more, and there were also two, but none of them tried alone. Among them, the decision of history participating in the case was the common practice in Qin and early Han dynasties. " History plays an indispensable role in it. Prison history is not only involved in trials, but also undertaken by prison history. When the court decides prison, there must be the participation of history, otherwise the verdict will be questioned and the officials in charge will even be held accountable. In fact, there are those in charge of prison affairs in the history of order, in which case it should belong to the history of prison; prison history is divided into different levels, including the history of order, that is to say, not all the history of prison is the history of prison. History is also graded in the trial process, and is not unrestricted.
