中國(guó)法形象在西方啟蒙時(shí)代的爭(zhēng)議與終結(jié)——以黑格爾對(duì)中國(guó)法的評(píng)論為中心

【摘要】：作為一種敘事的傳統(tǒng),西方在歷史上始終關(guān)注中國(guó)法形象。18世紀(jì)啟蒙時(shí)代,中國(guó)法形象在西方啟蒙思想家那里出現(xiàn)了爭(zhēng)議:一派極力稱贊中國(guó)法,另一派則傾向于否定中國(guó)法。面對(duì)爭(zhēng)議,德國(guó)古典哲學(xué)家黑格爾敏銳地發(fā)現(xiàn)了這一問題,并通過自己嚴(yán)密的理論徹底否定了中國(guó)法。經(jīng)過黑格爾的理論分析及其批判,中國(guó)法的正面形象在西方宣告終結(jié)。
[Abstract]:As a narrative tradition, the West has always paid attention to the image of Chinese law in history. During the enlightenment era of the 18th century, the image of Chinese law appeared controversial among western enlightenment thinkers: one faction praised Chinese law strongly. The other school tends to negate Chinese law. In the face of controversy, German classical philosopher Hagel acutely discovered this problem and completely denied Chinese law through his own strict theory. Through Heger's theoretical analysis and criticism, the positive image of Chinese law ends in the West.
