法律碩士應(yīng)用型人才結(jié)構(gòu)要素的實(shí)證分析

【摘要】:國務(wù)院學(xué)位辦和全國法律碩士專業(yè)指導(dǎo)委員會(huì)聯(lián)合頒發(fā)的關(guān)于《全日制法律碩士專業(yè)學(xué)位研究生指導(dǎo)性培養(yǎng)方案(法學(xué))》在培養(yǎng)目標(biāo)和培養(yǎng)方式中對法律碩士學(xué)生的知識(shí)、能力和素質(zhì)結(jié)構(gòu)作出了明確規(guī)定,但是在教育實(shí)踐中多數(shù)培養(yǎng)單位并未引起足夠的重視,甚至存在實(shí)踐教學(xué)虛化,培養(yǎng)方式和法學(xué)碩士雷同化的嚴(yán)重傾向,法律碩士應(yīng)用型研究生知識(shí)、能力和素質(zhì)結(jié)構(gòu)不合理、不協(xié)調(diào),完全背離了專業(yè)碩士教育的目標(biāo)。判定某一專業(yè)人才知識(shí)、能力、素質(zhì)結(jié)構(gòu)是否合理的標(biāo)準(zhǔn)主要有兩個(gè):一是,專業(yè)人才知識(shí)、能力和素質(zhì)結(jié)構(gòu)與法律實(shí)踐的契合程度;二是,專業(yè)培養(yǎng)方案與國家指導(dǎo)方案相對一致程度與創(chuàng)新程度。另外,國家已開始實(shí)施研究生教育的轉(zhuǎn)型發(fā)展戰(zhàn)略,使我國的研究生教育從以培養(yǎng)學(xué)術(shù)型人才為主向以培養(yǎng)應(yīng)用型人才為主轉(zhuǎn)變。因此,順應(yīng)轉(zhuǎn)型發(fā)展的要求,建立以法律實(shí)踐為導(dǎo)向,以法律職業(yè)能力培養(yǎng)為核心,知識(shí)、能力和素質(zhì)協(xié)調(diào)發(fā)展的法律碩士教育制度勢在必行。 本文所說的法律碩士應(yīng)用型人才是指在具有社會(huì)主義法治理念、德才兼?zhèn)、高層次的專門、實(shí)務(wù)型法律(法學(xué))專業(yè)的人才。所謂知識(shí)結(jié)構(gòu)就是知識(shí)系統(tǒng)諸要素相對穩(wěn)定的組織方式。在本文中主要是指法律碩士應(yīng)用型人才的理論知識(shí)與實(shí)踐知識(shí)、必修課與選修課的比例。本文中的素質(zhì)結(jié)構(gòu)主要是指職業(yè)素質(zhì)和綜合素質(zhì)的組織方式;能力結(jié)構(gòu)指職業(yè)能力和綜合能力的組織方式。 本研究力圖以法律碩士應(yīng)用型人才的知識(shí)、能力和素質(zhì)結(jié)構(gòu)的實(shí)證分析為抓于,以法律實(shí)踐為導(dǎo)向,在調(diào)查問卷的基礎(chǔ)上展開。文章分為三個(gè)部分,第一部分主要從法律碩士應(yīng)用型人才在知識(shí)、能力、素質(zhì)方面的現(xiàn)狀進(jìn)行闡述;第二部分是在立足法律碩士應(yīng)用型人才在知識(shí)、能力、素質(zhì)方面的現(xiàn)狀,分析法律碩士應(yīng)用型人才在這三個(gè)方面存在的問題及其原因;第三部分則是根據(jù)第二部分中分析出法律碩士應(yīng)用型人才在這三方面存在的問題和原因,積極尋找對策,從而完善我國法律碩士應(yīng)用型人才的教育模式。
[Abstract]:The State Council academic Affairs Office and the National Law Master Professional steering Committee jointly issued the "guiding training Program for full-time legal Master degree postgraduates (Law)" on the knowledge of legal master students in the training objectives and ways of training, The structure of ability and quality has been clearly defined, but in the educational practice, most of the training units have not attracted enough attention, and there is even a serious tendency of virtual practice teaching, training methods and the assimilation of LL.M. The structure of knowledge, ability and quality of applied graduate students of law master is unreasonable and uncoordinated, which completely deviates from the goal of professional master's education. There are two main criteria for judging whether a professional's knowledge, ability, and quality structure are reasonable or not: first, the degree to which the professional talents' knowledge, ability and quality structure are in agreement with the legal practice; Second, professional training programs and national guidance programs are relatively consistent with the degree of innovation. In addition, the country has begun to carry out the transformation and development strategy of postgraduate education, so that the postgraduate education in our country has changed from cultivating academic talents to training applied talents. Therefore, it is imperative to establish a legal master's education system, which is oriented by legal practice, centered on the cultivation of legal professional competence and coordinated with the development of knowledge, ability and quality in accordance with the requirements of transformation and development. The application-oriented talents of the master of law in this paper are those who have the concept of socialist rule of law, both moral and talented, and high-level specialized, practical law (law) professionals. The so-called knowledge structure is the relatively stable organization mode of the various elements of the knowledge system. In this paper, it mainly refers to the theoretical and practical knowledge of applied talents, the ratio of compulsory courses to elective courses. The quality structure in this paper mainly refers to the organization mode of the professional quality and the comprehensive quality, and the ability structure refers to the organization mode of the professional ability and the comprehensive ability. This research tries to focus on the empirical analysis of the knowledge, ability and quality structure of the applied talents of the Master of Law, and to take the legal practice as the guidance, based on the questionnaire. The article is divided into three parts, the first part is mainly from the legal master applied talents in the knowledge, ability, quality of the status quo; The second part is based on the current situation of the knowledge, ability and quality of the applied talents of the master of law, and analyzes the problems and reasons of the three aspects of the applied talents of the master of law; The third part is based on the second part of the analysis of the legal master applied talents in these three aspects of the problems and reasons, actively looking for countermeasures, so as to improve the education model of applied talents of legal masters in our country.
