【摘要】：正從法學(xué)視角來看,前幾屆全會(huì)對法治的關(guān)注大多在私法領(lǐng)域,此次十八屆四中全會(huì)首次關(guān)注公法,并首次將"依法治國"作為全會(huì)的主題。實(shí)際上,"依法治國"自1996年即已提出,黨的十五大將其寫入報(bào)告,十六大、十七大均有類似表述。此次四中全會(huì)提出"依法治國",可謂老樹新枝。與前幾屆相比,本次全會(huì)的新意之處是提出了諸多具體的制度性改革方案,意在改變長期存在的體制弊端,具有分水嶺的意義。一、改革依托:中國特色社會(huì)主義法治
[Abstract]:From the perspective of law, most of the previous plenum's attention to the rule of law is in the field of private law. The fourth Plenary session of the 18th CPC Central Committee first paid attention to public law, and for the first time took the theme of "ruling the country by law" as the theme of the plenum. In fact, "ruling the country according to law" has been put forward since 1996, and the 15th National Congress of the Communist Party of China has written it into the report. The 16th and 17th National Congress of the Communist Party of China all have similar statements. The fourth Plenary session of the Central Committee put forward the "rule of law", can be described as old trees and new branches. Compared with the previous sessions, the new idea of this plenary meeting is to put forward a lot of concrete system reform plans, in order to change the long-standing system malpractice, which has the significance of watershed.
