【摘要】：中國特色社會主義法治的本質(zhì)特征體現(xiàn)了中國共產(chǎn)黨的領(lǐng)導(dǎo)、人民當家作主、全面推進依法治國三者有機統(tǒng)一。黨的領(lǐng)導(dǎo)是中國特色法治最根本的特征,人民當家作主是中國特色法治的目的本質(zhì),依法治國是中國特色法治的實踐本質(zhì)。"三統(tǒng)一"理論的形成既具有歷史演進的內(nèi)在邏輯機理,也是立足于中國國情并融合吸納世界法治的有益成分而得出的科學定義。在實踐層面堅持"三統(tǒng)一"理論要合理界定和妥善處理執(zhí)政黨和法治之間的關(guān)系、以人民當家作主為目標堅持和完善人民代表大會制度、以依法執(zhí)政為抓手建設(shè)法治政黨拓展法治建設(shè)的路徑,引領(lǐng)法治中國建設(shè)。
[Abstract]:The essential characteristics of the rule of law in socialism with Chinese characteristics embody the leadership of the Communist Party of China, the ownership of the people by the people, and the overall promotion of the organic unity of ruling the country according to law. The leadership of the Party is the most fundamental feature of the rule of law with Chinese characteristics, the people's ownership is the aim essence of the rule of law with Chinese characteristics, and the rule of law by law is the practical essence of the rule of law with Chinese characteristics. " The formation of the "three unifications" theory not only has the inherent logical mechanism of historical evolution, but also is a scientific definition based on China's national conditions and incorporating the beneficial elements of the world's rule of law. At the practical level, it is necessary to rationally define and properly handle the relationship between the ruling party and the rule of law by adhering to the theory of "three unifications", and adhere to and improve the system of the people's Congress with the goal of people being the masters of the country. Taking ruling by law as the starting point, the ruling-by-law party expands the path of rule-by-law construction.
