地方科學(xué)立法的實踐困境與路徑選擇——以廣東為例

【摘要】：科學(xué)立法是當(dāng)今中國地方立法的一個重大理論和實踐課題,也是地方推進良法善治的邏輯前提。廣東被譽為我國地方立法的"試驗田",其立法經(jīng)驗具有重要的啟示價值。近年來,我國地方立法取得了長足的發(fā)展,但亦面臨立法抄襲、立法碎片化、立法技術(shù)不足等諸多困境和挑戰(zhàn),故在地方立法實踐中,我們應(yīng)積極進行增量法制變革,理性而務(wù)實地對待地方重復(fù)立法,明確可以重述上位法的邊界與范疇;實行開門立法,創(chuàng)造性地踐行地方立法行為,藉立法協(xié)商制度提升地方法治理念。同時,重視立法技術(shù),以期提升地方立法的質(zhì)量,從而為我國地方的法治建設(shè)打下堅實的制度基石。
[Abstract]:The scientific legislation is a major theoretical and practical project of local legislation in China, and it is also a logical premise to promote good governance at the local level. Guangdong is known as the "test field" of local legislation in our country, and its legislative experience is of great inspiration value. In recent years, the local legislation of our country has made great progress, but it also faces many difficulties and challenges such as the copying of legislation, the fragmentation of the legislation and the shortage of the legislation, so in the practice of local legislation, we should actively carry out the incremental legal reform, the rational and practical treatment of the local repeat legislation, It is clear that the boundary and category of the position law can be restated, the legislation of opening the door is introduced, the local legislative act is creatively practiced, and the idea of local rule of law can be promoted through the system of legislative consultation. At the same time, we should pay more attention to the legislative technology, with a view to improving the quality of local legislation, so as to lay a solid foundation for the building of the rule of law in our country.
