網(wǎng)絡(luò)言論對傳統(tǒng)言論的影響

【摘要】：隨著網(wǎng)絡(luò)技術(shù)的不斷成熟和網(wǎng)絡(luò)空間的無限拓展,網(wǎng)絡(luò)已經(jīng)成為人們傳遞信息、溝通交流、發(fā)表言論的開放舞臺�？梢哉f,網(wǎng)絡(luò)的出現(xiàn)使言論自由進入了一個全新的時代。然而,任何新生事物的出現(xiàn)都會受到各種因素的制約與影響,網(wǎng)絡(luò)言論也不例外。所以崇尚自由、追求真相、維護公平正義的網(wǎng)絡(luò)言論都是有益的,應(yīng)該受到法律的積極保護。但是,對于那些歪曲事實、顛倒是非、侵犯他人隱私權(quán)利、影響社會公共秩序的不良言論,我們應(yīng)該采取必要措施進行合理的限制。因此,保護網(wǎng)絡(luò)言論的健康發(fā)展勢在必行。 本文通過對網(wǎng)絡(luò)言論的概念、特征進行分析,認識到網(wǎng)絡(luò)言論具有傳統(tǒng)言論所不可比擬的各種優(yōu)勢,也極大地豐富了言論自由的內(nèi)容和形式,真正有效地體現(xiàn)了言論自由的真諦,網(wǎng)絡(luò)言論為言論自由翻開了新的篇章。網(wǎng)絡(luò)言論已經(jīng)對人們的生活產(chǎn)生了深遠的影響,顯現(xiàn)出了其應(yīng)有的價值。因此,對于網(wǎng)絡(luò)言論我們要正確的對待,合理的利用,更應(yīng)對其進行有效的規(guī)范,使其走上健康發(fā)展的道路。 保障人權(quán),保護公民權(quán)利已經(jīng)成為時代發(fā)展的潮流。網(wǎng)絡(luò)言論的保護,是對傳統(tǒng)言論自由保護的發(fā)展�？v觀我國的現(xiàn)行法對網(wǎng)絡(luò)言論的規(guī)定,仍然是以禁止性規(guī)定為主,要求人們只有在法律允許的范圍內(nèi)可以發(fā)表言論,限制了各種網(wǎng)絡(luò)言論行為。無論從我國立法指導(dǎo)思想,還是立法技術(shù)上講,都不符合當代中國法制發(fā)展的要求。網(wǎng)絡(luò)言論這一新的言論表達方式的出現(xiàn),使某些群體感覺驚慌失措,他們視網(wǎng)絡(luò)言論如“洪水猛獸”一般,要求嚴格規(guī)制。筆者認為：人們要正視網(wǎng)絡(luò)言論,為言論自由“松綁”,發(fā)揮其應(yīng)有的價值。 網(wǎng)絡(luò)言論的出現(xiàn)不僅對言論自由理論產(chǎn)生了深遠影響,而且對我國現(xiàn)行法律也有所沖擊�，F(xiàn)行法對網(wǎng)絡(luò)言論的保障還沒有形成完備的法律體系,我國憲法及其他基本法律的規(guī)定也還存在一些不足之處。為了更好的保護網(wǎng)絡(luò)言論,我們應(yīng)當在借鑒國外經(jīng)驗的基礎(chǔ)上,開啟網(wǎng)絡(luò)言論保護的新思路。應(yīng)該認識到除依靠法律外,還應(yīng)當注重發(fā)揮網(wǎng)絡(luò)管理技術(shù)及用戶控制對規(guī)范網(wǎng)絡(luò)言論的作用,強化對公民網(wǎng)絡(luò)基礎(chǔ)知識的教育,同時加強網(wǎng)絡(luò)言論保障問題的研究,確保網(wǎng)絡(luò)言論走上健康發(fā)展的道路。
[Abstract]:With the continuous maturity of network technology and the infinite expansion of cyberspace, the network has become an open stage for people to transmit information, communicate and express their opinions. It can be said that the emergence of the Internet makes freedom of speech into a new era. However, the emergence of any new things will be restricted and affected by various factors, Internet speech is no exception. Therefore, advocating freedom, pursuing truth and safeguarding fair and just online speech are beneficial and should be actively protected by the law. However, we should take necessary measures to limit the bad statements that distort facts, reverse right and wrong, violate other people's privacy rights and affect public order. Therefore, it is imperative to protect the healthy development of network speech. By analyzing the concept and characteristics of online speech, this paper recognizes that Internet speech has many advantages over traditional speech, and greatly enriches the content and form of freedom of speech. It truly embodies the true meaning of freedom of speech, and Internet speech opens a new chapter for freedom of speech. Internet speech has had a profound impact on people's lives, showing its due value. Therefore, we should treat network speech correctly, make use of it reasonably, and regulate it effectively to make it develop healthily. Protection of human rights and protection of civil rights has become the trend of the development of the times. The protection of network speech is the development of traditional freedom of speech protection. Throughout the current law of our country, the regulation of Internet speech is still mainly prohibition, which requires people to express speech only within the scope permitted by law, which limits all kinds of online speech behavior. Neither the guiding ideology of legislation nor the legislative technology can meet the requirements of the development of contemporary Chinese legal system. The emergence of Internet speech, a new way of expression of speech, makes some groups feel panicked. They regard Internet speech as a "monster" and demand strict regulation. The author thinks: people should face up to the network speech, "untie" for the freedom of speech, give play to its due value. The emergence of online speech not only has a profound impact on the theory of freedom of speech, but also has an impact on the current law of our country. The current law has not yet formed a complete legal system for the protection of network speech, and there are still some deficiencies in the constitution and other basic laws of our country. In order to better protect network speech, we should open a new way of network speech protection on the basis of foreign experience. It should be recognized that, in addition to relying on the law, emphasis should also be placed on giving play to the role of network management techniques and user control in regulating online speech, strengthening education on the basic knowledge of citizens' networks and strengthening research on the issue of Internet expression protection, To ensure that online speech on the road to healthy development.
