【摘要】：《棠陰比事》是一部記載古代中國鞫案定讞事例的司法判案集,對中國古代法律史和社會史等方面的研究有極為重要的價值。20世紀(jì)中期,荷蘭漢學(xué)家高羅佩將《棠陰比事》譯成英文出版,是截至目前唯一的英文版本。高羅佩在譯本中展現(xiàn)出敏銳的學(xué)術(shù)眼光和深厚的學(xué)術(shù)功底,通過考察中國古代地方公堂和審案程序,他得出對中國古代法律的看法,與西方學(xué)界傳統(tǒng)上對中國古代法律的負(fù)面評價不同,高羅佩認(rèn)為中國古代司法體系的運(yùn)轉(zhuǎn)整體上還算良好。他對《棠陰比事》進(jìn)行了系統(tǒng)的文獻(xiàn)學(xué)整理,使得該譯本即便在今天也是�？弊罹嫉陌姹�。
[Abstract]:Tang Yin comparison is a collection of judicial cases recorded in ancient China, which is of great value to the study of ancient Chinese legal history and social history. Dutch sinologist Gaurope translated the book into English and published it as the only English version so far. In his translation, Gao shows a keen academic vision and a deep academic foundation. By examining the local courts and judicial procedures in ancient China, he has come to his views on ancient Chinese law. Different from the traditional negative evaluation of ancient Chinese law in western academic circles, Gao Rope thinks that the operation of ancient Chinese judicial system is still good on the whole. He made a systematic bibliographic arrangement of Tangyin, making the translation the most excellent version even today.
