【摘要】：借助索薩(Sosa)關(guān)于信念的實(shí)施模型,我們提供了法律情形中的優(yōu)異判斷的一個(gè)模型。在提供模型的過(guò)程中,當(dāng)代認(rèn)識(shí)論文獻(xiàn)對(duì)法律,尤其是對(duì)法律情形中優(yōu)異判斷的相關(guān)性是值得關(guān)注的。一個(gè)好的審判取決于證據(jù)的合適處理,還是實(shí)體判決如何構(gòu)成,二者是不同的。分別由法官和陪審團(tuán)做出的適切判決之不同也需要討論。
[Abstract]:With the help of Souza (Sosa) 's model of implementation of belief, we provide a model of superior judgment in legal situations. In the process of providing the model, the relevance of contemporary epistemological literature to the law, especially to the excellent judgment in the legal situation, is worthy of attention. A good trial depends on the proper handling of the evidence or the constitution of the substantive judgment. The difference between appropriate decisions made by judges and juries also needs to be discussed.
