【摘要】：唐宋時期分家律法的發(fā)展演變呈現(xiàn)出鮮明的時代印記。唐代分家律法重點在于強調(diào)父母在世時子孫不得別籍異財,積極倡導(dǎo)共財同居的家庭模式;北宋分家律法重點則擴展到對父母亡后的分家活動進行干預(yù)限控,意在通過保留墓地、祖宅以及設(shè)置祭田保障祭祀、周濟族人,來建構(gòu)家族宗法體制、維持家族延續(xù);南宋時代的分家律法著意于宣明親在即許分家析產(chǎn)的合法性,堅持以"生分"之制安定家族秩序,并規(guī)定預(yù)留養(yǎng)老田以作贍養(yǎng)之資,確保諸子析產(chǎn)之后父母老有所依。由唐至宋,分家律法的關(guān)注點,從父母在世時到父母逝世后;分家律法的內(nèi)容,從簡單到周備,從宏觀調(diào)控到細致規(guī)制,從強調(diào)禮教原則到重視實際操作,清晰表露出國家對家族干預(yù)的日趨強化。
[Abstract]:The development of the law of separation of families in the Tang and Song dynasties showed a distinctive mark of the times. The emphasis of the law of separation of families in the Tang Dynasty was to emphasize that the children and grandchildren of their parents should not change their wealth and actively advocate the family pattern of cohabitation. The law of separation of families in Northern Song Dynasty extended to intervene and control the separation activities after the death of their parents, in order to construct the patriarchal clan system and maintain the continuity of the family by reserving the graveyard, ancestral house and setting up the sacrificial offering to protect the sacrifice and the people of Zhou Ji. The law of separation of families in the Southern Song Dynasty was intended to declare the legitimacy of the separation of family and family, to insist on the system of "birth and separation" to stabilize the family order, and to stipulate that the endowment fields should be reserved for the purpose of supporting the family, so as to ensure that the parents would have some basis for their parents after the birth analysis. From the Tang Dynasty to the Song Dynasty, the focus of the separation law was from the time when the parents were alive to the death of the parents. The content of the law of separation from simplicity to preparation, from macro-control to careful regulation, from emphasizing the principle of etiquette and education to attaching importance to practical operation, clearly shows that the state's interference in the family is increasingly strengthened.
