【摘要】：正案情簡介某園林工程有限公司(以下稱蕭山園林)承建了某小區(qū)房地產(chǎn)施工項(xiàng)目,并把該項(xiàng)目中澆地基的工程轉(zhuǎn)包給了王某,王某系自然人。2011年3月,王某找到了張某等幾名人員替自己施工,勞動(dòng)報(bào)酬口頭約定按工作量當(dāng)日結(jié)算。同年9月,張某在前往施工的路途中發(fā)生交通事故受傷,后張某以上班途中發(fā)生非本人主要責(zé)任的交通事故為由,向當(dāng)?shù)厣鐣?huì)保險(xiǎn)部門申請工傷認(rèn)定。由于王某不具備用工資格,遵循勞動(dòng)關(guān)系上溯到具備用工資格主體的原則,1工傷保險(xiǎn)部門確定蕭山園林為勞動(dòng)關(guān)系主體方。但蕭山園林認(rèn)為,張某的工錢視其工作量當(dāng)天結(jié)算;上下班時(shí)間視施工進(jìn)度而定,無嚴(yán)格的規(guī)定,這兩點(diǎn)都符合勞務(wù)關(guān)系的特
[Abstract]:A garden engineering co., Ltd. (hereinafter referred to as Xiaoshan garden) has built a real estate construction project in a small area, and subcontracted the project of pouring foundation in the project to Wang mou, Wang mou is a natural person, in march 2011, Wang found Zhang and other personnel for their own construction, labor remuneration verbal agreement according to the workload of the same day settlement. In September of the same year, Zhang was injured in a traffic accident on the way to construction, and then Zhang applied to the local social insurance department for the identification of an industrial injury because of a traffic accident that was not his main responsibility on the way to work. Because Wang Mou does not possess the qualification of employment and follows the principle that the labor relationship goes back to the subject of the qualification of employment, the industrial injury insurance department determines that Xiaoshan garden is the main body of labor relations. But Xiaoshan garden thinks, Zhang's salary depends on its workload settlement on the same day; commuting time depends on the progress of construction, there are no strict regulations, these two points are in line with the special labor relations.
