【摘要】：在行政法的理論研究中,有許多學(xué)者都對合法預(yù)期保護(hù)的理論依據(jù)進(jìn)行具體地分析,比如:張興祥博士從法理學(xué)(法治的基本要求)、經(jīng)濟(jì)學(xué)(政策風(fēng)險的偏好)、心理學(xué)(避險求穩(wěn)的心理)以及公共政策學(xué)(管理效率的提高)四個不同的角度,論證了行政法中合法預(yù)期保護(hù)的理論依據(jù)。再如:余凌云教授則認(rèn)為行政法中合法預(yù)期保護(hù)的理論依據(jù)包括以下四個方面:信賴保護(hù)的觀念、法治的基本要求、良好行政的實(shí)現(xiàn)以及經(jīng)濟(jì)效率的提高。而在宏觀調(diào)控法的理論研究中,尚未有學(xué)者系統(tǒng)地對合法預(yù)期保護(hù)的理論依據(jù)問題進(jìn)行探討。因此,本文從法理學(xué)、經(jīng)濟(jì)學(xué)、經(jīng)濟(jì)法學(xué)三個不同的角度,對受控主體合法預(yù)期保護(hù)的理論依據(jù)進(jìn)行論證。
[Abstract]:In the theoretical research of administrative law, many scholars have made concrete analysis on the theoretical basis of legal expectation protection. For example, Dr. Zhang Xingxiang is based on jurisprudence (the basic requirements of the rule of law), economics (preference of policy risk). From four different angles, psychology (the psychology of avoiding risks and seeking stability) and public policy (improving the efficiency of management), the theoretical basis of legal expected protection in administrative law is demonstrated. For example, Professor Yu Lingyun believes that the theoretical basis of legal expected protection in administrative law includes the following four aspects: the concept of trust protection, the basic requirements of the rule of law, the realization of good administration and the improvement of economic efficiency. However, in the theoretical research of macro-control law, no scholars have systematically discussed the theoretical basis of legal expected protection. Therefore, from three different angles of jurisprudence and economic law, this paper demonstrates the theoretical basis of legal expected protection of controlled subjects.
