【摘要】：土地美學(xué)的法律規(guī)范兼具美學(xué)和法學(xué)雙重屬性,在城市中,集中體現(xiàn)為利用法律規(guī)范的形式對(duì)土地利用進(jìn)行規(guī)劃和限制以符合城市景觀美學(xué)。美國土地使用規(guī)劃中的美學(xué)規(guī)范屬于警察權(quán)的范疇,經(jīng)歷了司法拒絕、附帶性承認(rèn)和單獨(dú)承認(rèn)三個(gè)階段,并在歷史街區(qū)、地標(biāo)等的美學(xué)保護(hù)上發(fā)揮了重要作用。新中國成立以來,我國城市土地區(qū)劃法律體系中缺乏必要的"美學(xué)條款",通過借鑒美國的經(jīng)驗(yàn),我國應(yīng)當(dāng)在構(gòu)建城市土地區(qū)劃的美學(xué)規(guī)范時(shí)用原則性規(guī)范確立美學(xué)的獨(dú)立保護(hù)價(jià)值,在充分論證美學(xué)與其他公共利益聯(lián)系性的基礎(chǔ)上制定具體可操作的美學(xué)條款;建立公民參與制度并引入"環(huán)境權(quán)";對(duì)特殊區(qū)域進(jìn)行重點(diǎn)"美學(xué)保護(hù)";構(gòu)建"區(qū)劃獎(jiǎng)勵(lì)與懲罰"制度。
[Abstract]:The legal norms of land aesthetics have the dual attributes of aesthetics and law. In cities, it is embodied in the planning and restriction of land use in the form of legal norms in order to conform to the aesthetics of urban landscape. The aesthetic norms in land use planning in the United States belong to the category of police power, which has experienced three stages: judicial rejection, incidental recognition and individual recognition, and has played an important role in the aesthetic protection of historical blocks and landmarks. Since the founding of the people's Republic of China, the legal system of urban land zoning in China has lacked the necessary "aesthetic clauses". Our country should establish the independent protection value of aesthetics with the principle norm when constructing the aesthetic norm of urban land regionalization, and make specific and operable aesthetic clauses on the basis of fully demonstrating the connection between aesthetics and other public interests. Establishing the system of citizen participation and introducing "environmental right"; carrying on the key "esthetics protection" to the special area; constructing the system of "regionalization reward and punishment".
