【摘要】：在少數(shù)民族的歷史發(fā)展和文化傳承中,少數(shù)民族習(xí)慣法具有正式規(guī)范不可替代的作用,基于歷史和現(xiàn)實(shí)的原因,它對于少數(shù)民族群體及其成員的文化心理、思維模式和行為方式都具有極為重要的影響。在現(xiàn)代社會(huì)中,少數(shù)民族習(xí)慣法依然具有傳承文化、增強(qiáng)民族凝聚力、維持社會(huì)秩序、規(guī)范個(gè)體行為等重要價(jià)值。在以法治為標(biāo)志的社會(huì)治理現(xiàn)代化進(jìn)程中,少數(shù)民族習(xí)慣法表現(xiàn)出與法治理念的價(jià)值斷裂、經(jīng)濟(jì)社會(huì)轉(zhuǎn)型中的價(jià)值遞減和民族社會(huì)發(fā)展中的個(gè)體價(jià)值認(rèn)同弱化等問題。在推進(jìn)全面依法治國的進(jìn)程中應(yīng)努力實(shí)現(xiàn)國家法體系的功能和習(xí)慣法價(jià)值的協(xié)調(diào)適應(yīng)、加快習(xí)慣法在法治進(jìn)程中的價(jià)值適應(yīng)性、發(fā)揮社會(huì)轉(zhuǎn)型中習(xí)慣法的獨(dú)特價(jià)值、以群眾的廣泛積極參與增強(qiáng)習(xí)慣法的法律實(shí)效,使習(xí)慣法逐漸適應(yīng)法治國家建設(shè)的目標(biāo)和要求。
[Abstract]:In the historical development and cultural heritage of ethnic minorities, the customary law of ethnic minorities plays an irreplaceable role as a formal norm. For historical and practical reasons, it is of great importance to the cultural psychology of minority groups and their members. The mode of thinking and behavior have extremely important influence. In modern society, minority customary law still has important values such as inheriting culture, strengthening national cohesion, maintaining social order and standardizing individual behavior. In the process of the modernization of social governance marked by the rule of law, the customary law of ethnic minorities shows some problems, such as the breakage of value from the concept of rule of law, the decline of value in economic and social transformation, and the weakening of individual value identity in the development of national society. In the course of promoting the comprehensive rule of law, we should strive to realize the function of the national law system and the coordination and adaptation of the customary law value, accelerate the value adaptability of the customary law in the process of rule of law, and give play to the unique value of the customary law in the social transformation. With the extensive and active participation of the masses, the legal effectiveness of the customary law should be enhanced, and the customary law would gradually meet the objectives and requirements of the construction of a country ruled by law.
