【摘要】：與明初相比,成化弘治年間武職犯罪的審理程序發(fā)生了一定的變化,涉及現(xiàn)實與祖制的沖突,原告軍民、被告武職與司法審判官員等多方當(dāng)事人的利益平衡,以及文官權(quán)力在司法監(jiān)察領(lǐng)域的擴張及其內(nèi)部的權(quán)力劃分等諸多問題,且主要通過條例的制定與修改來實現(xiàn)。《皇明條法事類纂》記載了大量與武職犯罪相關(guān)的條例,對研究的開展大有裨益。
[Abstract]:Compared with the beginning of the Ming Dynasty, the trial procedure of the martial duty crime in Chenghua Hongzhi period has changed to a certain extent, which involves the conflict between the reality and the ancestral system, the balance of interests of the plaintiff, the military and the civilian, the accused and the judicial officials, and so on. As well as the expansion of civil power in the field of judicial supervision and the division of power within it, and so on, and it is mainly realized through the formulation and amendment of the regulations. "the compilation of laws and regulations of the Emperor's Ming Dynasty" records a large number of regulations related to the crimes committed by military officers. It is of great benefit to the development of the research.
