【摘要】：我國(guó)法律法學(xué)話語(yǔ)中,最為最基本的是分析機(jī)制,法律解釋方法具有非常重要的作用,而法學(xué)解釋方法運(yùn)行過(guò)程中,相關(guān)人員要充分踐行法律解釋規(guī)則,將不同的理解規(guī)則和解釋規(guī)則整合在一起,從而實(shí)現(xiàn)法律規(guī)則的優(yōu)化運(yùn)行。特別要注意的是,在運(yùn)行法律解釋項(xiàng)目的過(guò)程中,研究人員要對(duì)不同意識(shí)形態(tài)下的相關(guān)匹配理論進(jìn)行集中的梳理,從而提高法律解釋規(guī)則的實(shí)效性價(jià)值。本文從相近概念辨析、法律方法論研究以及意識(shí)形態(tài)影響三個(gè)層面分析了法學(xué)話語(yǔ)中法律解釋的規(guī)則,旨在從多角度對(duì)法律解釋規(guī)則進(jìn)行深度剖析,為法學(xué)理論研究人員提供有價(jià)值的參考建議。
[Abstract]:In the discourse of legal jurisprudence in our country, the most basic is the analysis mechanism, the method of legal interpretation plays a very important role, and in the course of the operation of the method of legal interpretation, the relevant personnel should fully practice the rules of legal interpretation. The different rules of understanding and interpretation are integrated together to realize the optimal operation of the rules of law. In particular, in the process of running the legal interpretation project, the researchers should concentrate on the relevant matching theory under different ideology, so as to improve the effective value of the legal interpretation rules. This paper analyzes the rules of legal interpretation in the discourse of law from the three aspects of close concept discrimination, study of legal methodology and ideological influence, in order to analyze the rules of legal interpretation from many angles. To provide valuable reference for the legal theoretical researchers.
