法治評(píng)估的量與質(zhì)

【摘要】：如何走出一條合乎我國國情的評(píng)估之路是當(dāng)前法治評(píng)估亟需回答的問題。系統(tǒng)認(rèn)識(shí)評(píng)估中"量"與"質(zhì)"的關(guān)系是關(guān)鍵。評(píng)估學(xué)及法治評(píng)估的西方源起與本土化的實(shí)踐,決定了中外在法治評(píng)估"量"與"質(zhì)"的表現(xiàn)及二者關(guān)系上存在差異。一方面是西方法治評(píng)估表現(xiàn)出的"西方憲政體制的縮影"與我國法治評(píng)估所呈現(xiàn)出的"嵌入性"之間的差異,一方面是方法論上的定量定性方法的運(yùn)用及兩者關(guān)系的差異。我國當(dāng)前的法治評(píng)估所呈現(xiàn)出在"量"與"質(zhì)"的關(guān)系上是失衡的,可以在強(qiáng)化運(yùn)用既有理論成果的基礎(chǔ)上,嘗試以價(jià)值性評(píng)估進(jìn)路破解量化法治難題,并在評(píng)估方法優(yōu)化之外,著眼于提高評(píng)估過程的民主化程度、增強(qiáng)評(píng)估結(jié)果的合目的性。由此,可望促進(jìn)法治評(píng)估中"量"與"質(zhì)"的均衡關(guān)系,倡導(dǎo)法治建設(shè)的系統(tǒng)論、平衡觀。
[Abstract]:How to find a way to evaluate the rule of law is a problem that needs to be answered. The relationship between "quantity" and "quality" in systematic evaluation is the key. The practice of western origin and localization of evaluation and evaluation of rule of law determines the difference between Chinese and foreign countries in the performance of "quantity" and "quality" of evaluation of rule of law and the relationship between them. On the one hand, there is the difference between the "epitome of the Western constitutional system" and the "embeddedness" in the evaluation of the rule of law in western countries; on the other hand, the use of quantitative and qualitative methods in methodology and the difference between them. The current evaluation of the rule of law in our country is out of balance in the relationship between quantity and quality. On the basis of strengthening the application of the existing theoretical achievements, we can try to solve the problem of quantifying the rule of law by the way of value evaluation. Besides the optimization of evaluation methods, it aims at enhancing the democratization of the evaluation process and enhancing the purposefulness of the evaluation results. Therefore, it is expected to promote the equilibrium relationship between quantity and quality in the evaluation of rule of law, and advocate the system theory and balance view of the construction of rule of law.
